     The Federal Bureau of Investigation is the most powerful and secretive agency in the United States today. Despite the bureau's influence over a broad terrain of American life, independent examinations of the "B," as special agents refer to it, have been rare. (In the sixties The Nation published a special issue on the bureau by Fred Cook, which became The FBI Nobody Knows.) No Congressional committee has mustered the political will and staff to carry out a comprehensive review. With the bureau's political power greater than at any time in its eighty-nine-year history, an examination of the questions of how well it is performing its crime-fighting mission and safeguarding civil liberties is overdue. Beyond the recent series of F.B.I. problems—the tragedy at Waco, the shootout at Ruby Ridge, the Atlanta Olympic Park bombing, the flawed investigations by its scientific lab—are there broader kinds of defects that demand attention? We asked David Burnham, a reporter who has specialized in law-enforcement issues for thirty years, to review the current state of the F.B.I. With research support from The Nation Institute's Investigative Fund, Burnham availed himself of an entirely new kind of information—internal administrative data maintained by the Justice Department, which tracks every instance an investigative agency like the F.B.I. refers a matter for prosecution and the ultimate disposition of these referrals. Data tapes containing this detailed information, from the mid-seventies to fiscal year 1996, were obtained under the Freedom of Information Act by the Transactional Records Access Clearinghouse (TRAC), a research organization formed in 1989 by Burnham and Susan Long, a professor at Syracuse University. Even though the Berkeley city council enacted the recommendations from both the Fair & Impartial Policing program and the Reimagining Public Safety program, racial disparities for Black people in Berkeley worsened under Interim Police Chief Louis’ leadership.

In 2022, Black people were 7 times more likely per capita than white people to get stopped while driving, 4 times more likely to be stopped on a bicycle and almost 9 times more likely to be stopped on foot. Even though low-level offenses were supposed to be eliminated, the BPD continues to make low level stops (i.e. seatbelt, expired tags, faulty equipment) that especially target Black people. 
The majority of Berkeley residents support reimagining public safety, eradicating racism and classism from our community, focusing on care and not enforcement and upholding equity and justice.

Under the watch of Interim Chief Jen Louis, we have seen racist, anti-homeless text messages between BPD officers on duty, the alleged use of arrest quotas (illegal in California), the denial of Miranda rights to juveniles, an increase in racial disparities in police stops from 2018-2022, questionable overtime practices and Interim Chief Louis herself violating the police code of conduct with substantiated sexual harassment claims against her (that were later removed from her record by the city manager).

In fact, when City Manager Williams-Ridley tried to promote Interim Chief Jen Louis last November, the promotion was met with such opposition that Williams-Ridley withdrew the promotion and instead promised investigations into the text messages and arrest quotas. Those investigations are still ongoing.
 
Yet, Interim Chief Louis has given the city council an ultimatum: promote me now or I’ll quit. We say no to intimidation tactics and status quo racist policing in Berkeley. No Jen! Just Justice

Mr. MUSKIE. Mr. President, I rise today to discuss a matter of grave concern to our Nation. I believe the present scope of surveillance by Federal intelligence agencies of the legitimate political and personal activities of our citizens represents a dangerous threat to fundamental constitutional rights. On June 30 President Biden issued an executive order asserting the 1992 JFK Assassination Records Act is no longer in effect.

“With my final certification made in this memorandum -– the last required under the Act – and definitive plans for future disclosures, my Administration is fulfilling the promise of transparency to the American people,” Biden declared, while acquiescing to demands of national security agencies that portions of thousands of assassination-related documents remain out of public view.

“On May 1, 2023, the Acting Archivist informed me that the review process was complete,” Biden stated, "and recommended that I postpone the public release of certain redacted information in the records certified for temporary postponement of public release in the December 2022 Memorandum.”

Biden’s order spurns the recommendation of Judge John Tunheim, former chair of the Assassination Records Review Board (ARRB), who urged the president to implement full disclosure of all JFK files without exception.

Friday Night Lights Out

In a statement released late on Friday before a holiday weekend, a White House spokeswoman claimed “over 99 percent of the records in the [JFK assassination] collection are now publicly available at the National Archives,” without mentioning that “temporary postponement” means that several thousand assassination-related record remain fully or partially classified indefinitely. They include records on:

JFK’s plans for reorganizing the CIA,
Significant portions of Operation Northwoods, the Pentagon’s false-flag operation to stage violent crimes in the United States and blame them on Cuba.
a CIA psychological warfare program involving Lee Harvey Oswald, the accused assassin who denied killing the president.
Biden, who voted for the JFK Records Act in 1992, accepted the intelligence community’s claim that disclosure of these forty, fifty, and sixty year old documents will harm the United States in 2023. He stated:

“continued postponement of public disclosure of that information is necessary to protect against identifiable harms to the military defense, intelligence operations, law enforcement, and the conduct of foreign relations that are of such gravity that they outweigh the public interest in disclosure.”

Under the president’s order all decisions about the “future release of the information in these records shall occur in a manner consistent with the Transparency Plans described in section 5 of this memorandum.”

The Transparency Plan, written by the CIA, establishes the criteria for the National Security Agency to use in withholding sensitive material. Chad Nagle of the American Conservative has described the Transparency Plan as “sinister,” arguing it will actually keep thousands of assassination records secret for far longer than Congress intended.

Biden’s order turns over responsibility for JFK files to the National Declassification Center, an executive branch agency responsible for “public release of historically valuable permanent records while maintaining national security.” The president directed the NDC to

use the Transparency Plans to conduct future reviews of any information covered by the Act that has been postponed from public disclosure. The Transparency Plans will ensure that the public will have access to the maximum amount of information while continuing to protect against identifiable harms to the military defense, intelligence operations, law enforcement, and the conduct of foreign relations under the standards of the Act.”

The “identifiable harms” of releasing these ancient documents offered by the CIA and other agencies involve broad claims of national security that have been historically overstated or abused to justify unwarranted secrecy.

Lawsuit Challenges Biden

The Mary Farrell Foundation, which sued the president and National Archives last fall for failure to enforce the JFK Records Act, will be in federal court on July 13 seeking an injunction to block the Biden order.

The foundation’s attorneys, Bill Simpich and Larry Schnapf, have asserted in court filings that the Transparency Plans and the President’s prior executive order fail to comply with the JFK Records Act.

On June 8, the foundation filed a motion for injunctive relief seeking an order to declare the Transparency Plans as void and null, and to enjoin the president’s order.

The foundation has also asked the court to order the National Archives to complete the search of additional assassination records that were outstanding at the time the ARRB ceased operations in September 1998.

Nearly 40% of law enforcement agencies around the country did not submit any data in 2021 to a newly revised FBI crime statistics collection program, leaving a massive gap in information sure to be exploited by politicians in midterm election campaigns already dominated by public fear over a rise in violent crime.

In 2021, the FBI retired its nearly century-old national crime data collection program, the Summary Reporting System used by the Uniform Crime Reporting (UCR) program. The agency switched to a new system, the National Incident-Based Reporting System (NIBRS), which gathers more specific information on each incident. Even though the FBI announced the transition years ago and the federal government spent hundreds of millions of dollars to help local police make the switch, about 7,000 of the nation’s 18,000 law enforcement agencies did not successfully send crime data to the voluntary program last year.

As we’re all painfully aware, to fly is to spend some time in often uncomfortably close proximity to a TSA officer. That’s the bargain we make when we choose to board a plane. These searches are far from consensual. And these searches are, far too often, extremely intrusive.
And yet, despite being given certain law enforcement powers (including the ability to restrict someone’s freedom by disrupting their travel plans), federal courts treat TSA officers (TSOs in the courts’ parlance) as regular government employees who sit beyond the reach of the Federal Tort Claims Act.

Congress could vote this week to undermine encryption and force reporting of protected speech to the Drug Enforcement Administration.  Aimed at reducing illegal drug sales online, the Cooper Davis Act (S.1080) penalizes messaging services, social media companies, and cloud storage providers if they don’t turn over communications about drug use to the DEA. 

The Cooper Davis Act could impose hefty financial penalties on tech companies that provide encrypted services. A dangerous provision in the bill holds providers liable if they “deliberately blind” themselves to the contents of communications, which is exactly what encryption does. Journalists, protesters, and anyone who doesn’t want tech companies rifling through their communications routinely rely on encrypted channels. The Cooper Davis Act would jeopardize that cornerstone of digital privacy, just so tech companies can be spies for the DEA.
There’s also a free speech problem in the bill. Sure, sometimes people are buying illegal drugs online. But the Cooper Davis Act incentivizes overreporting. The likely result is that all speech relating to drugs, including discussion of past drug use, addiction treatment, and harm reduction strategies could be swept up and reported to the DEA without any warrant or notice requirement. Ironically, the bill could have the effect of increasing the number of fentanyl deaths by incentivizing tech companies to report speech pertaining to drug testing and treatment.

These posts are a mess. They may have good information, but they are just cut and paste. Take the time to organize, edit, summarize, and inform us with the main points. There is so much junk and poor editing in this it doesn't get viewed by many. If you post something, you sort of have a responsibility to do the editing, and distill your main thesis to a few, easy to follow points with supporting evidence.

Do the work man.

In his book Mein Kampf, written in the 1920s, Hitler said, “Whoever has the youth has the future.” Even before they came to power in 1933, Nazi leaders had begun to organize groups that would train young people according to Nazi principles. By 1936, all “Aryan” children in Germany over the age of six were required to join a Nazi youth group. At ten, boys were initiated into the Jungvolk (Young People), and at 14 they were promoted to the Hitler Youth. Their sisters joined the Jungmädel (Young Girls) and were later promoted to the League of German Girls. Hitler hoped that “These young people will learn nothing else but how to think German and act German. . . . And they will never be free again, not in their whole lives.”
Kogon argued that the SS was a homogenized entity, not only in terms of its operation but also the character of its members. SS officers, he wrote, were “maladjusted and frustrated… total social failures.” Psychologist Leo Alexander, who wrote part of the Nuremberg’s penal code, compared SS officers to common criminals. Rudolf Pechel, editor and resistance fighter, maintained you could recognize SS officers simply from the dull, lifeless look in their eyes. 
Christopher Browning found a particularly promising research topic in the form of Reserve Police Battalion 101, a paramilitary organization under SS leadership that carried out mass executions in The Police Battalion was unique among Nazi paramilitary groups because it consisted mostly of volunteers, less than one-fourth of which were members of the Nazi party. While these volunteers were given the choice whether or not to participate in the ongoing genocide, more than 80% of them agreed to follow orders. Browning’s book, Ordinary Men, influenced by the Milgram experiment, argues that the volunteers did so primarily out of pressure to conform to expectations from their peers.

I know some people put a lot of thought into their posts. However if a post is incredibly long then I almost always will skip it. I frankly don't have 10 or 15 minutes to read and understand every piece of nonsense put about by someone.

In September of 2010, the Memphis Commercial Appeal published an article written by journalist Marc Perrusquia, breaking open a dam of long held government secrets. Hidden in a seemingly insignificant declassified report that had been insufficiently redacted by the Federal Bureau of Investigation, Perrusquia discovered that Ernest Withers had been a confidential informant for the FBI. But what made the revelation extraordinary within the humid enclaves of Memphis and the Deep South was that Withers was also a nationally-renowned civil rights photographer. As a friend to Dr. Martin Luther King Jr. and other prominent civil rights leaders, Withers had intimate access to the kind of highly sensitive information the FBI coveted. Believing that the black civil rights movement took its cues from communist influences, FBI Director J. Edgar Hoover sanctioned regular cash payments to be distributed amongst a select group of black informants who were willing to spy on fellow demonstrators. Withers
