The FBI has a long history of misconduct, dating back to the J. Edgar Hoover years when agents were writing letters to civil rights leaders encouraging them to kill themselves.
Since then, investigations and leaks have exposed the FBI’s insular attitude that values incremental law enforcement wins over respect for enshrined rights. The addition of the FBI to the national security matrix following the 9/11 attacks hasn’t made the agency better. It’s only given them more venues for misbehavior.
The FBI radicalizes societal misfits and people with mental health issues to ensure a steady stream of counter-terrorism wins. It refuses to abandon junk science simply because it’s so much easier to obtain convictions by ignoring actual science. And it oversteps constitutional bounds with alarming frequency to make it appear the agency is super-productive when it comes to fighting crime.
Who can reform this agency? One would have hoped Attorney General Merrick Garland could rein in the worst impulses of FBI agents. But that hasn’t happened, even if the Biden’s AG has at least instituted some positive, if incremental, changes.

US-NATO proxy war in Ukraine utilizes space technology

An investigation of the Federal Bureau of Investigation (FBI) Laboratory was initiated by the Office of the Inspector General (OIG) in September 1995 in response to allegations raised by an FBI special agent.
Abstract
The investigation focused on three laboratory units: Explosives Unit, Chemistry-Toxicology Unit, and Materials Analysis Unit. Several broad areas of concern surfaced in the course of the investigation, particularly the impact of laboratory issues on criminal cases. The OIG did not find evidence of systemic contamination or improper evidence handling by laboratory employees but did raise serious criticisms of the performance of certain FBI employees. The FBI cooperated fully with the investigation and determined ineffective management within the laboratory resulted in problems being overlooked. In addition, the FBI agreed certain examiners failed to uphold high standards of professionalism. The FBI concurred with each of the 40 major recommendations contained in the OIG report and also adopted measures to improve the quality of the laboratory's work that exceeded OIG recommendations. Actions the FBI has taken in response to OIG recommendations are noted that relate to accreditation, laboratory restructuring, examiner reports, examiner training, and quality assurance.

After Donald Trump was forced to vacate the Oval Office to make way for its newest tenant, he apparently decided to cement his legacy by walking off with boxes full of classified documents. When the National Archive and Records Administration began filing away the records Trump actually deigned to turn over to it, it found a bunch of classified information. This led to an investigation by the DOJ and, ultimately, a raid of Trump’s Mar-a-Lago residence to recover any other classified documents the ex-president might have taken with him.
Trump’s response to this investigation and raid was just as nonsensical as his response to any other of his numerous scandals: he claimed he had issued a standing order to immediately declassify any classified documents he walked out the door with. This obviously makes no sense. First, the President can’t actually issue this sort of order. Second, even if a President could, there would still need to be a declassification review process to ensure documents were properly redacted before being placed into the public domain.
Finally, his claim of a standing declassification order was rebutted by several Trump administration officials, his former national security advisor (John Bolton), his former Attorney General (Bill Barr), and two former White House Chiefs of Staff.
The Massachusetts branch of the ACLU decided to ask around to see if any of the many agencies generating classified documents had a copy of this supposed standing order from the President

While juvenile justice spending continues to fall, however, it still far surpasses the money spent per youth by the School District of Philadelphia (SDP)—specifically, more than twice what the SDP spends annually. In FY2021, for example, the SDP spent over $30,000 per student compared to over $50,000 spent per system-involved youth. Also concerning, however, are the racial disparities that continue to persist within the system. The analysis found that in FY2019, for instance, 41% of youth aged 10-19 were Black but represented 81% of youth arrests. 

Additionally, the rising cost per system-involved youth per fiscal year continues to pose a problem despite the overall decrease in spending. According to the analysis, juvenile justice costs have soared by 36% from FY2017 to FY2021. Residential juvenile justice facilities are the leading drivers of youth justice costs. In FY2019, the cost per youth detained at the Philadelphia Juvenile Justice Services Center alone totaled over $220,000.

The biggest lie of all
In Part 1 I described The Big Deception: how common features of news coverage mislead us about the reasons powerful institutions do things.  While policies are usually portrayed in the news as good faith attempts by people in power to pursue shared values based on evidence, daily news stories ignore and even obscure most of the actual reasons our world looks the way that it does.  The reasons our society looks like it does in its most important respects exist along a longer and more complex causal chain than is typically represented in everyday news.  Deceiving people about this complexity leads them to misunderstand how to fight for the changes they want to see in our world. 
In Part 2, I examined the most obvious and superficial way the news deceives people about why things happen: by uncritically reporting the stated motivations of powerful people as the actual reasons they do things. 
Here in Part 3, I go deeper.  I explain why the choice to focus on the intentions of powerful people by reporters is perhaps the biggest deception of all.  This focus makes it harder for news consumers to understand the underlying conditions and structural features of our society that determine what choices are available to politicians, which of those options politicians will predictably select, and how entrenched bureaucracy will implement those choices.
1)    How might this play out in coverage of a common “public safety” issue?
To see what I mean about the difference between news coverage of the motivations of people in power versus news coverage of a longer causal chain of reasons, let’s take a hypothetical news story and compare different ways of covering it.

The suicide of a police officer in the small town of Santa Maria, California (north of Santa Barbara) has brought up again the issue of sexual abuse of teenage girls by police officers. The officer took his own life as he was about to be arrested for having sexual relations with a 17 year old girl in a Police Explorers program. The problem of police sexual abuse of teenage girls was first examined in a 2003 report by Sam Walker and Dawn Irlbeck (see the Articles) page of this web site. In response to that problem and other police sexual misonduct, the International Association of Chiefs of Police published a report on Addressing Sexual Offenses and Misconduct by Law Enforcement in 2011 (posted with the 2003 Walker and Irlbeck report). Barr McClellan studied at the University of Texas in Austin. As a student McClellan was a strong supporter of John F. Kennedy. After qualifying as a lawyer he went to work for the administration of President Lyndon B. Johnson. Initially he worked for the National Labor Relations Board but in 1964 he became an attorney for the Federal Power Commission.
In 1966 McClellan joined the legal firm of Clark, Thomas and Winters, based in Austin, Texas. At that time the firm was run by the partners Edward Clark, Sam Winters, Don Thomas and Frank Denius. The company was closely associated with Lyndon B. Johnson and the Democratic Party in Texas. McClellan's work included advising on political strategy, campaign contributions, media issues and labour disputes.
In 1972 McClellan became a full partner in the legal firm. It was only at this stage that he was told about the illegal activities of the firm. John Cofer explained how the partners dealt with criminal activity: "In short, we helped plan crimes and keep the clients out of trouble." Soon afterwards he discovered that one of the partners, Edward Clark, had been involved in planning the assassination of John F. Kennedy.

BPD Officer Accused of Racist Violence in Federal Lawsuit
Copwatcher with footage from 2017: "It's hard to believe that BPD had no idea that this guy has such a racism problem"
We are not surprised by allegations of racist violence and a federal lawsuit filed against Berkeley and Berkeley Police Sergeant David Marble. The recent lawsuit describes an incident on July 16, 2022, when Brian Lindhurst Jr was visiting a friend in Antioch, who happens to be a neighbor of Marble’s. The lawsuit alleges that Marble approached the men, used racial slurs, punched Lindhurst in the face and threatened him with a gun. 

Berkeley Copwatch has identified footage of Marble from 2017 that clearly demonstrates his racial animus as he interrupts a young, Black man to say, “Don’t give me that ‘Black’ crap.” He proceeds to escalate the situation and falsely arrests the man, who is eventually released after being threatened with force and arrest.

This video corroborates Lindhurst’s account of racist violence. The video shows a situation of false arrest becoming escalated and increasingly dangerous for the detained man. The man was outraged because he knew his rights, knew that it was a false arrest and knew that it was racially motivated. To our knowledge, no complaint or lawsuit was ever filed in this situation. 

According to Paul Kealoha Blake, the Copwatcher who recorded the original incident in 2017, “This is just one of the many times that I have encountered Marble on the street over the years. He is almost always messing with a person of color. It's hard to believe that BPD had no idea that this guy has such a racism problem.” 

In a recent Berkeleyside article, Matthai Chakko claims that there are “systems of review, investigation and discipline built into our police operations.” In fact, BPD and the civilian oversight board, the Police Accountability Board (PAB), are not protecting the community from racist police violence. The Berkeley police often refuse to report and share information with outside agencies. The BPD continues to prevent the PAB from its investigations by withholding necessary information and access. This prevents PAB from fulfilling its charter to provide oversight and accountability of the BPD. 

Berkeley Copwatch demands:   
• Officer Marble must be removed from the BPD so he can no longer intimidate, degrade and abuse our community. 
• The Berkeley City Council must address racism within BPD and release those who engage in it. 
• The Contra Costa District Attorney must review the incident and re-consider charging him with hate crimes as described by the plaintiff.

FBI INFORMANT SENTENCED TO LIFE 

In the series of trials which followed the capture of the Ohio 7, the government relied heavily upon the testimony of an informant named Joseph Aceto (aka: Joseph Balino), a former member of Statewide Correctional Alliance for Reform (SCAR), a prisoners-rights organization founded in Portland, Maine during the early 1970s by Tom Manning and Ray Luc Levasseur.  Aceto offered considerable "evidence" concerning the original formation of the SMJJ, its evolution into UFF, and supposedly first-hand recollections of the defendants' having described their bombing and bank-robbing exploits to him. Only later did it emerge conclusively that the government's star witness had consistently lied under oath, passing off third-hand gossip and utter fabrications as conversations in which he himself had participated.   It also came out that Aceto had been diagnosed as psychotic and administered heavy doses of the tranquilizer Mellaril - to "increase his veracity" - prior to testimony.   To top things off, it was revealed that, in exchange for such testimony, the FBI had arranged for him to be released from prison where he was serving a life sentence for a brutal stabbing murder and placed on the federal witness protection program (a package with an $800 per month stipend).   All this information had been withheld from the defense - and consequently from the jury - at trial.

Raymond Luc Levasseur went underground with a revolutionary Marxist organization in 1974 and spent a decade in armed resistance against the American state. Radicalized by his experiences in Vietnam and by a stint in a Tennessee prison for the sale of marijuana, Levasseur became convinced that revolutionary action was a “necessary step in defeating the enemy — monopoly Capitalism and its Imperialism expression.” As a leader of the Sam Melville/Jonathan Jackson Unit, later called the United Freedom Front, he took part in a string of bombings and bank robberies targeting symbols of the state including government and military buildings and corporate offices. All active members of the UFF were arrested in 1984 and 1985 and sentenced to long prison terms, although the government’s effort to prosecute them (the Ohio 7) on separate charges of seditious conspiracy ultimately failed. Levasseur served twenty years of a 45-year prison sentence, approximately thirteen years of them in solitary confinement, before being released on parole in 2004. He continues to write and speak out for prisoners’ rights.

So what really happened at Kent State, Ohio 43 years ago tomorrow?
Based on last week's U.S. Department of Justice (DOJ) investigation report, we still might never know. Or will we someday learn the awful truth of that tragic day that left 4 dead in Ohio?
It seems that the key to the truth lies with Terry Norman.
In recently discovered film of the Kent State Shooting in 1970 (1:07.40 thru 1:08), FBI informant provocateur Terry Norman (photo at top) is the young man in the light colored sports jacket. Earlier that day Norman's mentor, Detective Tom Kelly from the Kent Police had attempted to have Norman's gun approved for carrying on campus during the demonstrations, but that approval never came so it's KEY that the video clearly shows Norman handing over his gun to Detective Kelly.
From forensic evidence expert Stuart Allen's analyses of the Kent State Tape in 2010, we learned that Norman shot that weapon at the May 4th demonstration as he was attacked & beat-up by students who saw his gun. (More on Terry Norman ~ Does Terry Norman Hold the Key to Kent State?.)
Watching these Kent State videos without sound, Norman's gun hand-off coupled with the post-Kent State Tape analysis, we now understand the importance of this interaction caught on video & at many other sources.
Norman's pistol 'created the sound of sniper fire.'
In response to the DOJ whitewash report Congressman Dennis Kucinich issued a statement:
“The letter also failed to indicate any efforts to reconcile the evidence in the recording with any prior statements about the incident made by FBI paid informant, Terry Norman, who was on campus that day and was known to have brandished a gun that might have created the sounds caught in the recording.
“While I appreciate the response from the Justice Department, ultimately, they fail to examine key questions and discrepancies. It is well known that an FBI informant, Terry Norman, was on the campus. That FBI informant was carrying a gun. Eye witnesses testified that they saw Mr. Norman brandish that weapon. Two experts in forensic audio, who have previously testified in court regarding audio forensics, found gunshots in their analysis of the audio recording.

Why is understanding the Kent State Ohio Massacre critical?
To understand the events of May 4, 1970 at Kent State and the four dead in Ohio, is to understand much of what has happened in our history before, during and after.
In the intervening 41 years, there have been a wide range of commissions, studies, research and theories of what actually led to twenty-eight Ohio National Guardsmen shooting into a crowd of anti-war protesters at Kent State University which left four college students dead on the ground.

Gary May's book tells the story of a white-on-white drive-by shooting in Alabama that took place in the narrow window between Selma's bloody Sunday and passage of the Voting Rights Act of 1965 that brought down Jim Crow for good. Ku Klux Klansmen from Birmingham arrived in a Chevrolet Impala looking to serve the great white race and did so on Highway 80 near Big Swamp Lake by shooting into the Oldsmobile driven by a Detroit housewife who had left five children behind to come South and help the civil rights movement. Shortly after noon the next day, President Lyndon B. Johnson announced that J. Edgar Hoover's Federal Bureau Investigation (FBI) had solved the Viola Liuzzo murder. He did not mention that a paid bureau informant rode in the Impala with three other Klansmen and made no attempt to stop the shooting (he may have fired the fatal shots himself).

There are a variety of reasons to alter, if not actually end, the Section 702 collection. Whatever value it may have in terms of national security, the very real fact is that it has been endlessly abused by the FBI since its inception.
It’s a foreign-facing collection, which means it harvests communications and data involving foreign targets of US surveillance. But there’s a massive backdoor built into this collection. Collecting foreign communications often means collecting US persons’ communications with foreign persons or entities.
That’s where the FBI has gone interloping with alarming frequency. US persons’ communications are supposed to be masked, preventing the FBI from engaging in warrantless surveillance of US-based communications. This simply hasn’t happened. And the FBI has not only performed second-hand abuse of this collection regularly, but it has equally regularly refused to be honest with the FISA court about its activities.

There are two major reasons that the U.S. doesn’t pass an internet-era privacy law or regulate data brokers despite a parade of dangerous scandals.
One, lobbied by a vast web of interconnected industries with unlimited budgets, Congress is too corrupt to do its job.
Two, the U.S. government is disincentivized to do anything because it exploits this privacy dysfunction to buy data, dodge warrants, and expand surveillance.
