Two Reports About FBI's Use of National Security Letters Reissued
Even the reports that are supposed to provide transparency about the FBI's use of national security lettters (NSLs) are secret—or at least a couple dozen pages of them are. NSLs are nonjudicial orders that allow the FBI to obtain information from companies, without a warrant, about their customers’ use of services. They almost always contain a gag order, which prohibits recipients from even saying they've received the request.

Two Office of the Inspector General (OIG) reports reviewing the FBI's use of NSLs from 2007 and 2008 were reissued earlier this week after having portions declassified. You can see the newly released versions of the 2007 report here and the 2008 report here.

Charlie Savage at the New York Times has reviewed and listed the changes. Some of them make sense. For example, one portion of the 2007 report masked references to a "Virginia Jihad network," which might have been redacted because of an ongoing investigation. But some of the previously classified portions are less explicable, such as the classification of the percentage of requests done under particular statutes. It's unclear what purpose keeping that number secret serves. What is clear is that excessive classification and redaction continue to get in the way of much-needed transparency around NSLs.

US Attorney’s Office names district election officer for NMI

(Press Release) — U.S. Attorney for the Districts of Guam and the NMI Alicia A.G. Limtiaco has announced that Assistant U.S. Attorney Garth Backe will lead the efforts of her office in connection with the Justice Department’s nationwide Election Day program for the upcoming Nov. 4, 2014 general elections.

Backe has been appointed to serve as the district election officer for the District of the Northern Mariana Islands, and in that capacity is responsible for overseeing the district’s handling of complaints of election fraud and voting rights abuses in consultation with Justice Department Headquarters in Washington
Limtiaco said, “Every citizen must be able to vote without interference or discrimination and to have that vote counted without it being stolen because of fraud. The Department of Justice will act promptly and aggressively to protect the integrity of the election process.”

The Department of Justice has an important role in deterring election fraud and discrimination at the polls, and combating these violations whenever and wherever they occur.

The department’s long- standing Election Day program furthers these goals, and also seeks to ensure public confidence in the integrity of the election process by providing local points of contact within the department for the public to report possible election fraud and voting rights violations while the polls are open on Election Day.

Federal law protects against such crimes as intimidating or bribing voters, buying and selling votes, impersonating voters, altering vote tallies, stuffing ballot boxes, and marking ballots for voters against their wishes or without their input. It also contains special protections for the rights of voters and provides that they can vote free from acts that intimidate or harass them. For example, actions of persons designed to interrupt or intimidate voters at polling places by questioning or challenging them, or by photographing or videotaping them, under the pretext that these are actions to uncover illegal voting may violate federal voting rights law. Further, federal law protects the right of voters to mark their own ballot or to be assisted by a person of their choice.

The franchise is the cornerstone of American democracy. We all must ensure that those who are entitled to the franchise exercise it if they choose, and that those who seek to corrupt it are brought to justice. In order to respond to complaints of election fraud or voting rights abuses on Nov. 4, 2014, and to ensure that such complaints are directed to the appropriate authorities, Backe will be on duty in this district while the polls are open.

Backe can be reached by the public at 236-2980.

In addition, the FBI will have special agents available in each field office and resident agency throughout the country to receive allegations of election fraud and other election abuses on Election Day. The FBI can be reached by calling Special Agent Haejun Park at 322-6934.

For the past two months, we’ve seen in various reports how under acting Attorney General Karl Rove, the Department of Justice pressured U.S. attorneys across the country to commence frivolous prosecutions of voting fraud cases. The cases were generally aggregated in close proximity to elections, in violation of the Department’s published policies, with two objectives. The first was to suppress voter registration efforts focused on traditionally Democratic constituencies, such as inner-city Blacks and Hispanics, and the second, to create a false impression in the mind of the public that the Democrats were engaged in voter fraud. As the New York Times discovered in its study, most of the voting fraud cases failed because there was no basis to pursue them, and even the cases which succeeded generally showed bona fide mistakes or misunderstandings, not any sort of fraud.

So, what happens when a prominent Republican figure is caught red-handed engaging in voter fraud? Über-Republican Ann Coulter was discovered to have falsified a voter registration in Palm Beach County, Florida, and to have voted. This perfectly tracks the factual pattern of a series of criminal prosecutions brought by Steven Biskupic, one of the originally targeted U.S. attorneys – in Milwaukee – who subsequently redeemed himself through political skullduggery.

However, in the Coulter case, the U.S. attorney’s office showed no interest in the case. State law enforcement officials did, however. And today we learn that the criminal investigation was closed—as a result of a direct intervention by federal officials supporting Coulter. The Palm Beach Post reports:

Conservative pundit Ann Coulter has been cleared of allegations that she falsified her Palm Beach County voter’s registration and voted illegally — this, after a high-level FBI agent made unsolicited phone calls to the Palm Beach County Sheriff’s Office to vouch for Coulter.

But wait, it gets still better:

County Supervisor of Elections Arthur Anderson, meanwhile, decried what he called “FBI intrusion.” He referred the Coulter case to PBSO after poll worker Jim Whited originally reported the incident. “This doesn’t bode well in terms of the public’s impression that celebrities receive preferential treatment,” Anderson said. “I’m curious about how anyone can justify the FBI’s intrusion.”

First-year Detective Kristine Villa in December was assigned the job of investigating whether Coulter committed a felony in February 2006, when she cast her ballot in the wrong precinct in a Palm Beach election after registering to an address that wasn’t hers.Villa’s report leaves the clear impression that Coulter’s attorney, Miami’s Marcos Jimenez, stonewalled Villa for five months—at times agreeing to make Coulter available, at others reneging, often not returning calls promptly or claiming not to be able to reach his client.

Coroner: Alcohol involved in boat crash that killed FBI workers


The barge involved in the fatal wreck sits in the middle of the Ohio River Downtown.
Alcohol played a factor in the Ohio River crash that killed two FBI employees in September, an official at the Campbell County Coroner's Office said.

Bryce Eastlick, 28, and John Stack II, 29 — both off-duty employees of the Cincinnati FBI office — were killed late Sept. 25 when their 19-foot pleasure boat slammed into a massive barge traveling down the Ohio River between Cincinnati and Newport, a Cincinnati fire official said.
"The toxicology report did confirm that it was alcohol related," an official at the coroner's office said Wednesday.
The coroner declined to release specifics, such as the men's blood alcohol content, and said the full autopsy report is not yet available.

5 Things Government Whistleblowers say you must know

LONDON, UK — No matter how much they dislike it, governments need calling out.

That’s what a group of whistleblowers who risked their careers, reputations and personal freedom to uphold said Friday. Now serving on the advisory board of ExposeFacts.org, a project of the Institute for Public Accuracy in Washington, they said the nature of government secrecy ensures that more people will have to take similar risks in the future — and that the consequences could be even greater.

“If whistleblowers are suppressed, which is the clear intention of the US and British governments, all that’s left is a flow of official information… which adds up to lies and war,” said ExposeFacts coordinator Norman Soloman.

The government doesn’t need to spy on people all the time to keep them in line. It just needs them to know that it can.

The U.S. National Security Agency and British equivalent, GCHQ, aren’t using all the information they’re gathering today, said J. Kirk Wiebe, a former NSA employee who went public after his 2001 retirement with information about the agency’s mass collection of individuals’ data. It’s being stored in a server to be used as evidence of crimes committed down the road.

Those who condone spying because they personally have nothing to hide should remember that it’s not clear what future governments will consider illegal, he said.

“The next time you hear someone saying ‘I’m not worried, I’m not doing anything wrong’ — rubbish,” Wiebe said. “You don’t get to choose what’s wrong.”

Surveillance doesn’t guarantee security.

“We are told that governmental secrecy is protecting us, when the truth is the opposite,” said Coleen Rowley, a former FBI special agent who exposed the agency’s intelligence failures before the Sept. 11, 2001 attacks.

A refusal to share intelligence within agencies, across agencies and with the public contributed to the attacks, the 9/11 Commission found.

Matthew Hoh, who resigned from the U.S. State Department in 2009 to protest American policy in Afghanistan, offered another example. In the wake of disclosures by former NSA contractor Edward Snowden, the Obama administration argued that the NSA’s surveillance tactics thwarted 54 terror attacks. After pressure from journalists and U.S. Sen. Patrick Leahy, the NSA confirmed just four cases, none of which were a direct result of the spying program.

“The government can scare and intimidate, but there has been no evidence that these tactics are helping,” Hoh said. “This is actually causing us to be much less secure.”

In the U.S., whistleblowers are worse than foreign spies.

The Obama administration has prosecuted more people under the Espionage Act than all other administrations combined, Solomon wrote in The Nation last month. It’s gone after journalists and government employees suspected of leaking information. It also created the National Insider Threat Policy, requiring government employees to report coworkers who may be passing on classified information.

“In effect, the people of the U.S. are to be viewed as the enemy from whom basic information about government actions should be withheld,” Solomon said.

“There’s nothing a government hates worse than embarrassment,” Wiebe added. “It’s almost worse than leaking a top secret.”

Woodward and Bernstein’s Watergate scoop probably couldn’t happen today.

Deep Throat, The Washington Post’s key anonymous source implicating President Richard Nixon’s administration, was FBI associate director Mark Felt.

Today, the first call reporter Bob Woodward placed to Felt would have been logged into NSA databases and easily traced by officials searching the leak’s source, Rowley said. Never mind all the security cameras that are surely covering the parking garage where they met.

History proves whistleblowers right. Eventually.

In 1963, the FBI called surveillance target Martin Luther King, Jr. the “most dangerous… Negro leader in the country.” Today, Rowley pointed out, he’s an American icon with his own federal holiday.

“It’s incredible what time can do,” she said. “And the reason is, facts come out.”

Similar reappraisals could be in store for whistleblowers such as Snowden and Chelsea Manning, who passed documents to Wikileaks, panelists said. Today, Manning is serving a 35-year prison sentence and Snowden is in exile in Russia.

"Both Chelsea and Edward are on the right side of history," Hoh said, "and they will be vindicated."

Court officials canceled a two-day pretrial hearing for suspects in the September 11 attacks on Monday at the US prison in Guantanamo Bay, Cuba, a US army spokesman said.

The hearing, intended to examine allegations the FBI tried to infiltrate legal defense teams, according to a docket on a Pentagon website. It would have been the first such proceeding since a US Senate report on CIA torture was released last week.

No reason was given for the cancellation.

Judge James Pohl, an army colonel, ruled in July that no conflict of interest arose for defense attorneys from the FBI approaching a security officer for a defense team.



The allegations surfaced in April, further delaying a complex, slow-moving case.

Lawyers for accused 9/11 mastermind Khalid Sheikh Mohammed and four other suspects want Pohl to determine the extent of FBI contact with defense team members.

Mohammed and fellow 9/11 suspect Ramzi Binalshibh were among prisoners who underwent torture by the Central Intelligence Agency, according to the report by the Senate Intelligence Committee released on Tuesday.

The report on the CIA interrogation program implemented after the9/11 attacks said Mohammed was subjected to waterboarding, or simulated drowning, “rectal hydration” and sleep deprivation.

Records Sought on FBI Probe of L.A. Jails





A Los Angeles group that runs a public affairs show sued the Department of Justice for records on the FBI's investigation of brutality and corruption in Los Angeles County jails.
The American Association of Women, based in Marina del Rey, runs the "Full Disclosure Network" TV show. It sued the Justice Department on Wednesday under the Freedom of Information Act, in District of Columbia Federal Court.
The Los Angeles Times reported in July this year that the FBI had launched a covert probe of brutality in the jail system because the agency believed that former Sheriff Leroy Baca and his undersheriffs might stymie the investigation.
The American Association of Women says it filed a FOIA request in July, which the FBI denied in August.
The association sought records and communications between the FBI and federal prosecutors in Washington and Los Angeles, relating to the decision to keep the investigation secret from Baca.
It also asked to see any communications between the FBI and Times reporters Cindy Chang and Jack Leonard.
It appealed the FBI's rejection, but the U.S. Office of Information Policy has yet to rule, though its statutory deadline was Oct. 29, according to the lawsuit.
The association claims it is being "irreparably harmed" by the withholding of records.
The lawsuit came just days after the announcement that the L.A. County Board of Supervisors agreed to settle a 2012 lawsuit alleging widespread abuses against inmates in the jail system by a cadre of deputy sheriffs.
The federal lawsuit Rosas v. Baca came after a series of reports by American Civil Liberties Union. Those reports laid bare an endemic system of brutality, that in some cases, "left inmates with shattered bones, eye sockets and teeth," according to the ACLU.
"There was even a gang of deputies inside the jails, dubbed 'The 3000 Boys,' inked up with signature tattoos, who proved their allegiance to the brotherhood by beating up inmates. Inmates with serious mental illness - deputies called them 'dings' - were prime targets for violent abuse," the ACLU said Wednesday in a statement announcing the settlement

More than a year after a Federal court found widespread discrimination in the Federal Bureau of Investigation, tensions are growing among Hispanic agents who were at the center of the landmark lawsuit, and many say they are now the targets of retaliation by the bureau.

''People say we won that lawsuit, but really we lost,'' said Gil Mireles, a decorated agent in San Antonio. Mr. Mireles says his career was derailed after 18 years with the F.B.I. because of his testimony against the bureau at the 1988 trial.

Since then, Mr. Mireles says, he has been kept out of major investigations, has been rejected for promotions and has even lost use of his bureau car. Some Hispanic colleagues in San Antonio complain of similar reprisals. ''For some of us things have gotten worse,'' Mr. Mireles said. F.B.I. Denies Any Retaliation The F.B.I. denies that there has been retaliation against Mr. Mireles or other Hispanic employees as a result of the the agents' successful lawsuit.

But Congressional investigators say that many complaints are valid and that Hispanic agents who were closely involved in the discrimination suit have found their careers stalled.

In interviews with more than 20 current and former Hispanic agents around the country, many said discrimination in the F.B.I. might have actually grown worse.

''My intention is to get out of the bureau,'' said Luis A. Monserrate Jr., an agent in Atlanta who was active in the lawsuit and now complains of being the victim of ''sham'' disciplinary investigations.

Outside Congress, there has been no independent review of the charges of retaliation. But private law-enforcement specialists say the allegations are not a shock. ''The F.B.I. is a big, imperfect institution, and frankly, it would surprise me if there wasn't some retaliation,'' said James J. Fyfe, a professor of justice, law and society at American University who has studied discrimination in the bureau.

Director Is Called Insensitive

The F.B.I. Director, William S. Sessions, a frequent target of criticism from Hispanic agents, is to appear before the House Judiciary Subcommittee on Civil and Constitutional Rights in the next few weeks to address the allegations of reprisals.

''We're very disturbed about what we're hearing,'' said Representative Don Edwards, a California Democrat who serves as head of the panel. ''Sessions isn't being tough enough on this issue.''

Representative Matthew G. Martinez, another California Democrat who has been a critic of the bureau's treatment of Hispanic employees, said an investigation by his staff showed that many of the accusations were true. ''It's tragic that the bureau is supposed to be the nation's defender of civil rights, yet it continues to defy the very reason for its existence,'' Mr. Martinez said.

The lawsuit by 311 agents alleging discrimination led to a decision that was seen as a major embarrassment for the bureau. Judge Lucius D. Bunton of United States District Court in Midland, Tex., ruled in September 1988 that Hispanic agents had been the victims of pervasive discrimination in assignments and promotions in the F.B.I.

The judge ordered the agency to overhaul its promotion policies for Hispanic agents but did not set timetables or quotas for their advancement. He also created a three-member panel to investigate allegations of discrimination and retaliation against those involved in the suit. The panel is only now beginning its review.

More Sanctions Are Sought

Antonio V. Silva, an El Paso lawyer who has represented all the Hispanic agents, said he would return to Federal court in the next few weeks to seek additional sanctions against the bureau. ''Retaliation has been occurring all over the United States and we want it stopped,'' he said.

F.B.I. spokesmen say that since Judge Bunton's ruling, the bureau has aggressively moved to eliminate prejudice in its ranks, and some Hispanic agents applaud the efforts.

''The bureau is definitely taking steps in the right direction,'' said Hector L. Lugo, a Puerto Rican agent who is the bureau's chief recruiter in New York.

In a statement made public last week, Mr. Sessions said, ''The F.B.I. is acutely aware of its obligations to protect the rights of employees,'' and he vowed ''stern disciplinary action'' if any retaliation charges were proved.

Rate of Promotions

Yet Hispanic agents say F.B.I. figures show that despite their court victory, there has not been a sharp increase in the number of promotions for Hispanic agents, especially at senior levels.

The number of Hispanic agents around the country who are supervisors has risen by about a dozen since last year, F.B.I. figures show, but all of that increase took place at the lowest salary levels.

Of the 349 agents at the highest basic salary level, only seven, or 2 percent, are Hispanic, and that number was unchanged from March 1989. None of the bureau's 56 field offices is run by an Hispanic agent. Of the bureau's 9,600 agents, Hispanic agents now make up about 5 percent.

Paul P. Magallanes, a Los Angeles agent who retired last July after 21 years in the bureau, said, ''It's been business as usual in regard to Hispanic agents.''

''People we thought were our friends are no longer our friends,'' he said.

Tension in Sessions's Old Town

The tension appears to be most pronounced in a handful of F.B.I. offices, including the one in San Antonio, where Mr. Sessions was a judge and Federal prosecutor for many years.

''My first 16 years in the bureau, I led a charmed life - I was part of every major investigation,'' Mr. Mireles said. ''The last two years have been sheer hell.''

Mr. Mireles, who is widely acknowledged as one of the bureau's most talented instructors in police tactics, is now assigned to low-profile surveillance duties.

Michael D. Wilson, the agent in charge of the F.B.I. office here, said he did not believe there had been any retaliation against Mr. Mireles or other agents, at least not since he arrived here six months ago. ''Retaliation is not a word in my vocabulary,'' Mr. Wilson said.

Agents elsewhere who were involved in the lawsuit say they have been the targets of internal investigations and disciplinary reviews intended to punish them for minor infractions of bureau rules.

Agents Cite Harassment

In Miami, many colleagues have rallied to the defense of a Cuban-American agent, Fernando E. Mata, who has been suspended during an investigation of allegations that he might have had improper contacts with Cuban intelligence agents or mismanaged counterintelligence duties.

Friends of Mr. Mata say that the investigation is based on old, unreliable information and that Mr. Mata, a counterintelligence specialist, is being punished because of his damaging testimony against the F.B.I. in the trial. The bureau denies the accusations.

Parsing through the lawyerly text, Olbermann called the “independent” NFL investigator out for his failure to reach profound conclusions or call for accountability, and wording about scanning through “available” information that implied the possibility that stones went unturned.

Mueller was also chided for taking employees’ word that they had not seen or received the elevator tape — an aggregate claim that would mean an AP report was maliciously fabricated by either a journalist or law enforcement source — at face value without meaningful skepticism. If proof that the AP report was accurate emerges at a later date, Mueller’s credibility will take a massive hit.

INSIDER ACCOUNT--Eight years ago I blew the whistle on the CIA’s torture program. I knew there’d be trouble, but I never could’ve predicted the years-long ordeal that followed. (Photo: John Kiriakou, the author.)

My revelations led to a four-year-long FBI investigation and five felony charges — against me, not the torturers. Facing a lifetime in prison, I pled guilty to a lesser charge of confirming the name of a former CIA colleague to a reporter who never published it.

That may sound familiar to you. It’s exactly what former CIA director David Petraeus did when he exposed the names of multiple undercover officers to his girlfriend. Petraeus took a plea to a misdemeanor. I didn’t have four stars on my shoulder, and I wasn’t a friend of the president’s, so I’d gotten stuck with a felony.

At sentencing, my judge gave me 30 months in prison and three years of probation, and she took away my federal pension. I left for prison believing that was the totality of my punishment. I was wrong.

One of the first things that happened upon my conviction was that the company with which I had my homeowner’s and auto insurance canceled my policies. They don’t do business with felons, they said. That same week, my credit card company canceled my card and demanded the immediate payment of the balance.

Then, shortly before my departure for prison, the agency that my wife and I used to hire child care providers also jumped on the bandwagon. They dropped us as clients and left us without anybody to help her care for our three young children while I was away.

When I finally came home from prison six months ago, I thought probation was all I had left to deal with. Yet even now, I’m still putting up with petty government harassment, even if the private sector has backed off.

I recently traveled to Greece to help the government there craft whistleblower and anti-corruption legislation. As a Greek-American and a whistleblower, I wanted to help my ancestral homeland climb out of its current political and economic troubles and get back on track.

I had great success in Greece, securing support for the legislation from the government and all major political parties. I’ll return to Greece in a few months to begin drafting the new law.

I landed back in Northern Virginia excited about my success and prospects in Greece. Imagine my surprise, then, when an immigration officer at Dulles International Airport stopped me and asked to see my passport.

BOSTON — As "Black Mass," the blockbuster film that tells the story of Boston crime boss James "Whitey" Bulger, attracts millions of viewers to theaters, Governor's Councilor Michael Albano recounted the time two of the film's central figures attempted to intimidate him.

In 1983, shortly after Albano was appointed to the state Parole Board, then-FBI agents John Connolly and John Morris dropped by Albano's office to talk about his vote recommending the commutation of the life sentence of Peter Limone, a reputed mobster who had been wrongly convicted for a 1965 Chelsea murder.

"Connolly comes in and starts saying, 'You can't do this, it's not good for you, this guy is going to go out on the streets,' and 'I understand you want to go into politics and have a political future, this will not be good for you,' " Albano said Monday. "That type of commentary, that was typical Connolly -- arrogant, know it all, all of that."

Ultimately, the board voted 5-2 to recommend that Gov. Michael Dukakis commute Limone's sentence to make parole a possibility but Dukakis denied the petition. Albano and the four other Parole Board members who voted in favor of commutation became the targets of a two-year criminal investigation by the State Police, he said. The investigation found no wrongdoing.

In 2001, Limone was released after serving about three decades in prison when the FBI was found to have been withholding exculpatory evidence proving Limone's innocence.
Connolly was convicted in 2008 of second-degree murder for having leaked information to Bulger, leading to the 1982 murder of businessman John Callahan in Florida. Connolly is currently serving a 40-year prison sentence.

Morris, a former supervisor of the organized crime unit at the Boston FBI office, admitted to accepting bribes from and leaking information to Bulger, but was granted immunity in exchange for testifying against the one-time Winter Hill Gang boss.

Jason’s death causes us so much pain, says sister

A sister of an Irishman who died after an attack in the US has spoken publically of her loss for the first time since the incident, saying his death would leave footprints across their lives forever.

Jason Corbett, was found with fatal head injuries at the home he shared in the North Carolina with his second wife, Molly Martens Corbett and his two children from a first marriage.

After his death on August 2, there was a legal battle as his wife tried to keep Jack, 11, and Sarah, 9, whom she had been an au pair to after their mother’s death, with her in the US.

Tracey Lynch, Jason’s sister, wanted to bring the children back to Limerick in line with her brother’s wishes. They are now living with their aunt and her husband David, who are the children’s legal guardians. The police probe into Jason’s death is expected to conclude next month.

Ms Martens Corbett, along with her father Tom, a retired FBI agent, are persons of interest in Jason’s violent death. It is believed that he was hit with a baseball bat at his home.

A message from Ms Lynch was posted on the Facebook page Bring Justice for Jason after her brother’s month’s mind Mass at Our Lady Queen of Peace Church in Janesboro, Limerick.

“This is not a moment. It’s a movement,” the Nation of Islam leader said, evoking memories from 20 years ago, as thousands came to attend the D.C. calling for an end racial injustice.

​Nation of Islam Leader Louis Farrakhan addressed the large gathering of demonstrators at the U.S. Capitol building during the “Justice or Else!” march commemorating the 20th anniversary of the Million Man March on Washington.

“I feel the cry of our ancestors the pain of those on whose shoulders we stand. I feel that the ancestors are happy that a young generation has arisen,” he said after greeting the crowd with an “As-salam Alaykoum,” the Arabic and Muslim expression that means “Peace be Upon You.”

The minister spoke from behind a bullet-proof glass as there were rumors and reports of possible violence against the African-American leader who is seen as controversial by many Americans, especially far-right anti-Islam groups, some of whom organized armed counter-protests.

Farrakhan praised the presence of Native Americans and Latino delegations at the march, emphasizing the need for cross-cultural unity against racial injustice.

“(Native-Americans) are here because they are the original owners of this part of the earth and we honor them with the honor they are justly due,” he said.

“They’re suffering in their land is very great. So all of those who cry for justice, know that no cry is greater than those who have suffered the most. And those who have suffered the most are the indigenous people not only of (the U.S.) but of the western hemisphere.”

Speaking on the recent African-American uprisings in the United States, Farrakhan attempted to appeal to the youth by praising the Black Lives Matter movement, saying they represent the future.

“Ferguson ignited it all. All the brother and sisters from Ferguson that challenged the tanks we are honored that you have come to represent our struggle and our demand,” he said.

Farrakhan also harshly criticzed the FBI, CIA, and IRS, saying that they could “Go to Hell,” while adding he has no fear of government institutions.

Throughout his speech he emphasized self-sacrifice and self-determination, urging the audience to practice to do whatever it takes to bring about change. “This is not a moment, it’s a movement,” he said. “The many are greater than the one.”

Notable figures present throughout the march, included Hip Hop artist J. Cole, internatonational pop star Janet Jackson, while other celebirites like Russel Simmons and Will and Jada Pinkett Smith endorsed and funded the march.

Almost 20 years ago, in 1995 thousand of protesters, mostly African-American men, attended the first Million Man March, a movement led by the Nation of Islam Minister Louis Farrakhan, who called upon Black men to travel to the country's capital, demanding change from the government.

According to official sources, it was the fourth-largest demonstration in Washington history, and the largest predominantly black gathering.

In an extraordinary step, psychologists James Mitchell and Bruce Jessen now face a federal lawsuit for their role in convincing the CIA to subject terror suspects to mock drowning, painful bodily contortions, sleep and dietary deprivation and other methods long rejected by much of the world as torture.

In practice, CIA torture meant disappearances, mock executions, anal penetration performed under cover of “rehydration” and at least one man who froze to death, according to a landmark Senate report last year. Versions of the techniques migrated from the CIA’s undocumented prisons, known as black sites, to US military usage at Guantánamo Bay, Bagram Airfield in Afghanistan and Abu Ghraib in Iraq.

On behalf of torture survivors Suleiman Abdullah Salim and Mohamed Ahmed Ben Soud, as well as a representative of the estate of Gul Rahman – who froze to death in a CIA black site in Afghanistan – the American Civil Liberties Union (ACLU) filed the suit against Mitchell and Jessen on Tuesday in a federal court in Washington state, where the two currently reside. They seek compensatory damages of at least $75,000.

The suit calls the torture program a “joint criminal enterprise” and a “war crime” in which the CIA, Mitchell and Jessen colluded and from which Mitchell and Jessen financially profited.

Although numerous US government investigations have pierced the veneer of secrecy around the torture program, the program’s government architects have faced no legal reprisal. A Justice Department inquiry ended in 2012 without prosecutions. The new lawsuit, aimed not at government officials but the contractors Mitchell and Jessen, aims to break the trend.

More importantly, however, in his two-hour presentation Minister Farrakhan said: I know you all think I killed Malcolm. If I killed Malcolm, do you think I would be here? See who was giving him mouth to mouth resuscitation? It was an FBI agent.

The idea elicits a Hollywood analogy in the movie "Shooter" starring Mark Walberg and Danny Glover. When the hero and the FBI agent went seeking wisdom from the old shooting expert, to the question, Who killed Kennedy? he responded, Those boys on the grassy knoll were dead within hours.

The FBI agent responded, You know this for sure? To which the expert responded, I still have the shovels in the back.

This sort of lends credence to the Ministers denial. Notwithstanding, Sonny Carson and Herman Ferguson both thought he did it. However, he may not have been at the Audubon to pull the trigger but to feign ignorance of the climate around Malcolm and the hit going down is not a tenable position.
