Jonathan Mark opened the discussion about 9/11 20th anniversary event planning. He is seeking to bring together peace activists and 9/11 truth researchers and all who want “a democracy that protects the Constitution, rather than disables it.” He asked for a contact with the 9/11 Consensus Panel that would provide their points of agreement to the public. Additionally, he seeks names of various 9/11 organizations to invite to, or to co-host, events. Jonathan suggested an event might show Massimo Mazzucco’s summary version of his September 11: The New Pearl Harbor movie. Cheryl Curtiss suggested uniting the anti-war folks, the Muslim community, civil liberty groups, and alternative media journalists. Lawyers’ Committee legal efforts progress
Immediate suggestions for additional persons to join the New York mandamus lawsuit are appreciated by the Lawyers’ Committee. David Meiswinkle told of the defendants’ motion to dismiss this lawsuit especially due to alleged “lack of standing.” The Courts give higher value for standing to plaintiffs who have lost a family member or those who were injured by explosions or during the cleanup efforts. The deadline for the Lawyers’ Committee response is Tuesday, March 3rd. Please contact an LC board member if you know of someone who meets these criteria and who is willing to join the lawsuit. David also spoke about bringing in a professional investigator and of setting up research committees for several areas including the WTC, the Pentagon, Shanksville, anthrax, government misconduct, etc., to collect evidence for potential grand juries. Barbara Honegger emphasized that the Lawyers’ Committee appreciates participatory help and underscored the need for more plaintiffs to join the lawsuit quickly.

Who Killed Malcolm X?
Frank Tolopko has studied the life and death of Malcolm X and reported on the release of a six-part docuseries on Netflix following the research of Abdur-Rahman Muhammad. Frank also pointed out several parallels of the assassination case to aspects of 9/11. Based on the new evidence uncovered, the Manhattan District Attorney has decided to reopen the murder investigation. Cheryl Curtiss will be interviewing Mr. Mohammad in the near future.

There are many ways the novel coronavirus may have come about/ Nass

“If someone were seeking to engineer a new coronavirus as a pathogen, they would have constructed it from the backbone of a virus known to cause illness,” the report said. “But the scientists found that the SARS-CoV-2 backbone differed substantially from those of already known coronaviruses and mostly resembled related viruses found in bats and pangolins.”—USAT

Well, yes, that is surely one relatively easy way to create a pathogen: string together known bits of DNA or RNA to create new organisms with virulence factors from known building blocks. But it is also relatively easy to detect the human hand in this type of chimera. And because plausible deniability is more important to such programs than creating a new pathogen, I doubt that is the path that would have been followed by a modern biowarfare lab.

So as not to encourage the development of biowarfare pathogens, I will only briefly mention some of the old techniques for creating them, which shoot holes into the Nature Medicine hypothesis of natural origin.

1. China has unique bats. So do other countries. Unique bats likely harbor unique viruses. Bits of these viruses can be strung together, while no outside parties are aware that these particular RNA threads exist in nature.
2. You take an already virulent RNA virus, subject it to high rates of mutation via chemical or radiological exposure, and test the viruses that survive for the acquisition of new virulence characteristics.
3. You simply passage the virus through tens, hundreds or thousands of lab animals and test the results for acquisition of new virulence characteristics.
4. You mix different viruses together with different virulence characteristics, allow them to grow together, and seek recombinants that have obtained a new mix of virulence factors.

All these possibilities result in viruses that are hard to pin on lab production. I dare the Nature Medicine scientists to so easily dismiss these scenarios.

Still, I doubt that any national program would deliberately release this coronavirus onto the people of the earth, because it is so hard to control. Our bio-weaponeers require that their creations be controllable, at all costs. An accidental release of a novel virus, which has happened frequently at national bio-labs worldwide, is the strongest hypothesis. Especially when we are told this coronavirus has a slow rate of mutation. In that case, why was something more homologous to it never seen before in nature?

We should not forget that all the august scientists and bodies who have claimed this event is entirely natural when interviewed by USAToday have vested interests: their research could be shut down as a result of worldwide revulsion for what has occurred.

As Karl Herchenroeder noted deeper in the piece, the fact of the existence of an FBI investigation involving the Telegram app surfaced as a result of a Freedom of Information Act (FOIA) request I filed last year with the FBI. In October 2019, the FBI responded to my FOIA with the following:


I appealed, but last month the Department of Justice’s Office of Information Policy (OIP) affirmed the FBI’s refusal to provide a single document mentioning Telegram. While I’m evaluating whether to sue DoJ over the denial, the fact that the Department has acknowledged that it has at least one (and likely far more) investigation of Telegram’s service underway is itself significant.
That former (Comey) and current (Wray) FBI directors have been waging public relations battles against public key encryption is well established. Comey of course actually went to court against Apple over the issue as it related to the San Bernardino Salafist terrorist incident. But what no senior federal official has been willing to admit is this: compromising the encryption utilized by tens of millions of Americans–including the family members of FBI, DEA, and other law enforcement officers at all levels–would make all of us more vulnerable to not just ordinary hacking, but potentially to kidnapping or even murder.
Comey, Wray and other security and surveillance hawks–most who have zero experience as computer programmers or cryptographers–continue to engage in magical thinking–convinced that somehow tech companies can develop encryption “backdoors” that only the government could access. As the data breaches at the Department of Energy and OPM (among others) have demonstrated, there’s no such thing as a safe crypto or IT security “back door”–if they exist, hostile actors will find and exploit them. The fact remains that the FBI has many tools to get at bad actors that misuse encrypted messaging apps like Telegram. Legislatively or court‐ mandated crypto “back doors” that place us all at risk should not be one of them.

Psychological Strategy Board




The Psychological Strategy Board (PSB) was a committee of the United States executive formed to coordinate and plan for psychological operations. It was formed on April 4, 1951, during the Truman administration. The board was composed of the Under Secretary of State, the Deputy Secretary of Defense, and the Director of Central Intelligence, or their designated representatives.[1] The board's first director was Gordon Gray, later National Security Advisor during the Eisenhower administration. The board was created in response to the growth of Office of Policy Coordination covert activities during the Korean War.[2]
Under Eisenhower, the board became a purely coordinating body. The board's function was reviewed by the Jackson Committee, chaired by William Harding Jackson, set up to propose future United States Government information and psychological warfare programs. The committee concluded that the board had been established on the assumption that psychological strategy could be conducted separately from official policy and actions, an assumption the committee disagreed with.[3] It was abolished September 3, 1953 by Executive Order 10483,[4] with its responsibilities being transferred to the Operations Coordinating Board.

As of August 2019, the FBI reported 57,812 firearms in its inventory. The FBI also maintains large quantities of ammunition for duty use, training, and periodic firearms qualifications. In addition, the FBI’s Tactical Section and Special Weapons and Tactics teams maintain a variety of specialty weapons and less lethal munitions, and diversionary devices. The FBI also employs Special Agent Bomb Technicians who maintain inventories of explosives.
Controls over Firearms – We found that the FBI has strong physical controls over its unassigned firearms, and Special Agents are personally responsible for properly safeguarding assigned firearms. The FBI tracks its firearms using the Asset Management System (AMS), its automated property management system. During our physical inventory we were able to locate all firearms selected for our sample. However, we identified over 360 firearms without a designated property custodian in AMS, which is against FBI policy. We also selected a sample of firearms during our site visits and traced all but two of them back to AMS. The FBI could not explain the origins of these two firearms, or how they came to be in FBI custody.
We also determined that our sample of firearms purchased during a 2 month period were properly entered into AMS in a timely manner. Additionally, we evaluated the FBI’s controls over firearms approved for disposal and identified deficiencies related to the accuracy of AMS records for destroyed firearms.
Lost and Stolen Firearms – We noted that between September 2016 and July 2019, 38 FBI Special Agents were disciplined for the loss or theft of 45 FBI-issued firearms. The FBI suspended 37 and dismissed 1 of the Special Agents held responsible for the loss or theft. Of the 45 lost or stolen firearms, 24 have been recovered, 1 of which was used in a crime. We also found that the FBI did not maintain complete documentation for 8 of the 45 lost or stolen firearms, including its make, model, or serial number; and a stolen firearm that was subsequently recovered more than 1 year ago was still marked as lost or stolen in AMS.

Controls over Ammunition – The FBI maintained duty ammunition at 14 of the 15 sites we reviewed. We found that the FBI stored its ammunition in secured areas with access limited to FBI personnel. However, we identified weaknesses in the FBI’s ammunition tracking and physical inventory policies that increase the risk of ammunition being lost or stolen without detection. As a result, we found that 6 of the FBI sites included in our audit were not tracking over 1.2 million rounds of ammunition, and another 7 sites were not adequately tracking ammunition.
Controls over Less Lethal Munitions and Diversionary Devices – The FBI maintained less lethal munitions and diversionary devices at 6 of the 15 sites we reviewed. Despite the lack of a policy establishing proper storage requirements, we found that the FBI stored its less lethal munitions and diversionary devices in a secure area with limited access. However, we identified weaknesses in the FBI’s tracking and physical inventory policies for less lethal munitions and diversionary devices that increases the risk of their being lost or stolen without detection. As a result, we found that one FBI site was not tracking less lethal munitions and diversionary devices and that the remaining five sites we visited were not adequately tracking them.
Controls over Explosives – The FBI maintained explosives at 8 of the 15 sites we reviewed. We found that the FBI properly stored its explosives in accordance with FBI policy. However, we found two explosive magazines used to store FBI explosives were not owned by the FBI, but rather by state and local law enforcement agencies. As a result, the bomb technicians of these other agencies had emergency access to the FBI’s explosives. Additionally, we identified weaknesses in the FBI’s explosives tracking and physical inventory policies that increase the risk of explosives being lost or stolen without detection. As a result, we found that only two of the eight sites included in our audit were adequately tracking their explosives inventories.
Controls over Firearm and Ammunition Evidence – We determined that the FBI had strong physical controls over firearm and ammunition evidence and access to the Evidence Control Rooms was limited to designated personnel and required a keycard, combination, and alarm code. The FBI tracks its firearms and ammunition evidence using SENTINEL. During our physical inventory of firearm and ammunition evidence, we located all items selected for our sample and traced a sample of firearm and ammunition evidence back to SENTINEL.
However, we identified concerns related to firearm evidence sent to the Firearms/Toolmarks Unit (FTU) for destruction. Specifically, the current process of shipping firearm evidence to the FTU for destruction creates a risk that firearms could be lost in transit without detection; and firearms are being marked as disposed in SENTINEL before the firearms are actually destroyed.

* Background
* I appreciate the opportunity to appear before the Committee to discuss my office’s report entitled The CIA-Contra-Crack Cocaine Controversy: A Review of the Justice Department’s Investigations and Prosecutions. Our 407-page report was completed in December 1997. It was the result of an exhaustive 15-month investigation into allegations that first appeared in August 1996 in a series of newspaper articles published by the San Jose Mercury News. Those articles, entitled “Dark Alliance: The Story Behind the Crack Explosion,” alleged that certain individuals associated with the Nicaraguan Contras had flooded South Central Los Angeles with cocaine in the 1980s. The articles further alleged that these individuals had used the proceeds from their drug trafficking to finance the Contras’ war against the Sandinista regime in Nicaragua. The articles suggested that these individuals helped spark the crack epidemic in Los Angeles and throughout the United States. More explosively, the stories implied that the Central Intelligence Agency (CIA) was aware of these individuals’ activities and either attempted to protect their drug dealing on behalf of the Contras or at a minimum turned a blind eye to it. The articles also suggested that these individuals were treated leniently by law enforcement authorities, including agencies of the Department of Justice, such as the Federal Bureau of Investigation (FBI), the Drug Enforcement Administration (DEA), the Immigration and Naturalization Service (INS), and various United States Attorneys’ Offices, because of their ties to the Contras or the CIA.
The Mercury News articles specifically focused on the drug operations of Ricky Ross, a major cocaine dealer in South Central Los Angeles and elsewhere. The series claimed that Ross’ meteoric rise as a drug trafficker was made possible by Oscar Danilo Blandon and Norwin Meneses, two Nicaraguans with ties to the Contras, who allegedly used the profits they earned from selling Ross massive amounts of cocaine to help fund the Contra war

His composed, understated delivery almost disguised the weighty magnitude of that disturbing word and the loaded adjective that preceded it. “I think what happened to him,” he said, referring to the president and the FBI’s counterintelligence investigation into his campaign, “was one of the greatest travesties in American history.”

"In December of 1992, Timothy McVeigh told me that while he was serving in the U.S. Army, he had been recruited to carry out undercover missions," Nichols wrote. "McVeigh did not say who had recruited him or specify the nature of his mission. McVeigh did say, however, that he was to begin making contacts with a 'network' of people after the first of the year."

The network was located "down south," Nichols wrote. Nichols claimed McVeigh threatened him and his family if Nichols did not cooperate in the bombing conspiracy. He claimed McVeigh identified Potts in "an accidental slip of the tongue."

Potts told the Oklahoman newspaper the allegations were "just nonsense and ridiculous." No further documentation was offered as part of the filing which would support the allegations.

Another affidavit alleging flaws in the official story of the Oklahoma City bombing was given by David Paul Hammer, who shared a cell with McVeigh prior to McVeigh's execution.

A few years ago, I was in Miami for a conference. I had contacted Judge Steven Leifman (Associate Administrative Judge, Miami-Dade County Court, 11th Judicial Circuit of Florida), who kindly agreed to meet and talk. Instead of going to his judicial chamber we went to a large, concrete building, under construction, within the City of Miami.

The space had been hollowed out. Echoes bounced off its cement walls and floors. Yet, Judge Leifman gave me a virtual tour, explaining what each area of the building would become and provide. The story I also heard of the building’s genesis humbly revealed how his dedicated, humanitarian work had convinced County officials to finance not just the building but what became The Miami-Dade Criminal Mental Health Project (CMHP).

I remain incredulous that other counties, cities, and states have not adopted this approach to people with serious mental illnesses (SMI, like schizophrenia, schizoaffective disorder, bipolar illness and some with PTSD). It is their SMI-induced disturbing behaviors (during states of psychosis) which result in their entering the criminal justice system, rather than being served by community-based, mental health services. When in good treatment, those illness driven behaviors abate. I hope this documentary opens many an eye to saving people, families, and money.

As Patrisse Cullors, founder of Black Lives Matter and whose brother has schizophrenia (and has been through the criminal justice system), says, “No one gets well in a cell.” In fact, people with serious mental disorders are more symptomatic in the confines of a jail or prison. Their incarceration stays are longer. When released, they are without the treatment necessary for their recovery, and thus suffer further, as do their families. Those with untreated SMI also are far more likely to re-offend, adding further financial and social burden to government and communities.

The three institutions in the U.S. “housing” the greatest number of people with SMI are: the Los Angeles County Jail, Chicago’s Cook County Jail and NYC’s Rikers Island. That fact seems a crime, in a manner of speaking.
The Definition of Insanity takes us deeply into the groundbreaking work of the CMHP. We follow a number of patients (clients of the CMHP), including: a formerly-incarcerated peer counselor (a “peer” is someone with life experience with a mental disorder) whose work is to assist current clients from their jail release to receiving community services; and another young man, who is employed while still under his court-ordered and supervised mental health care.  

This essence of the CMHP program is to divert people charged with a (generally non-violent) criminal offense from incarceration to care. Each person seen by the mental health court(s) that Judge Leifman pioneered is given a choice between incarceration and trial – though should they decide upon treatment, it will be under the Court’s supervision. If they do not adhere to their treatment plan, they are subject to re-arrest and potentially further jail time. By the way, many do not choose treatment.

District Attorneys and law-enforcement agencies, not only County government, have come to recognize the value of this program because it works — as we witness in this remarkable and compelling film. Since the inception of the CMHP, 10 years ago, arrests in Miami-Dade County have gone from 118,000 to 56,000, annually. Moreover, recidivism in clients who complete the program (both for felonies and misdemeanors) is less than 25% — a stunning reduction from the rate of approximately 80% before it began. To add to the proof of its effectiveness, jails are closing, which has saved Miami-Dade County $12 million a year. All of which, as I mentioned, leaves me greatly puzzled as to why this court diversion and treatment approach has not propagated throughout our country.

It takes a team to produce these kinds of results, including judges, peer counselors and treatment providers, as well as the clients themselves. "We want people to be part of their own change," says Judge Leifman.
This impetus and support for this film is deeply personal for Norman Ornstein and his family. They established the Matthew Harris Ornstein Memorial Foundation; Matthew is the son of Ornstein and his wife, Judith Harris, whom I have had the privilege of knowing. Their son died in 2015 after a ten-year struggle with serious mental illness. Ornstein knew and asked filmmaker Gabriel London to produce and direct this documentary. It was written and also produced by Charlie Sadoff. The Definition of Insanity is narrated by Rob Reiner.

It was Winston Churchill who said, “You can count on the Americans to do the right thing, after they had tried everything else.” Perhaps this is the time for this country to move beyond incarcerating people with serious mental illnesses, to do the right thing. To provide programs that will enable these people to receive the care that can benefit them, their families and their communities — and save tax-payers a lot of money.

Rasmus teaches economics at St. Mary’s College in California and has written a number of books, including Alexander Hamilton & The Origins of the Fed, and Central Bankers at the End of Their Ropes: Monetary Policy and the Coming Depression. The Oklahoma State Medical Examiner's Office has stopped answering Fox 25's questions about how an unidentified DNA profile from the Oklahoma City Bombing was shelved for nearly two decades. The ME's office says the decision to stop commenting is because this DNA profile is now the subject of an "open, active investigation."
One former state leader who led investigations into the bombing say it's long past time to identify that unknown person. "For me it is not that surprising because originally the charges were filed against McVeigh, Nichols and 'others unknown,'" said Former state representative Charles Key.
Key is the author of "The Final Report" which included the findings of the Oklahoma City Bombing Investigation Committee. "We got called names like 'conspiracy theorists' and things like that," Key said of his investigation, "And we never got answers to the questions

We have a very interesting call for you this month. We’ll start with Richard Gage and Ted Walter from Architects & Engineers for 9/11 Truth who will tell us about the organization’s effort to help a family in the UK that is trying to get the inquest into their son’s death reopened. Geoff Campbell was killed in the North Tower of the World Trade Center on 9/11, and his brother, Matt, has been fighting for years to get the inquest reopened, which would mean getting evidence for controlled demolition of the towers into a courtroom.

Our second speaker will be James Lee, who will present on the fires in California. James resides near the Mendocino Coast of Northern California and grows biodynamic and organic food at his 100-year-old farm. He graduated from the school of business at San Diego State University as well as attending the Green MBA program at New College in Santa Rosa, California. He has had more than 25 years experience working on Wall Street, and in 1991, he founded a small investment/research boutique, JWL Investments.

And our final speaker will be Dr. Beverly Rubik who will talk to us about Covid-19 and 5G.
She earned her PhD in biophysics in 1979 from the University of California at Berkeley. After a long career in research and education, she now works a practitioner and health educator who provides laboratory and clinical assessments. Beverly is also conducting research at the Health Medicine Center in Walnut Creek, CA.

Dr. Francis Boyle is an American human rights lawyer and professor of international law at the University of Illinois College of Law.
He served on the board of directors of Amnesty International, as a consultant to the American Friends Service Committee, and on the Advisory Board for the Council for Responsible Genetics. He drafted the US domestic implementing legislation for the Biological Weapons Convention, known as the Biological Weapons Anti-Terrorism Act of 1989, that was approved unanimously by both Houses of the US Congress and signed into law by President George H.W. Bush. He served as an adviser to the Palestine Liberation Organization (PLO) between 1987-89 and 1991-93.

William Binney is a former intelligence official with the United States National Security Agency (NSA) and whistleblower. He retired on October 31, 2001, after more than 30 years with the agency. In the 1990s, he co-founded a unit on automating signals intelligence with NSA research chief Dr. John Taggart. Binney’s NSA career culminated as Technical Leader for intelligence in 2001. He has expertise in intelligence analysis, traffic analysis, systems analysis, knowledge management, and mathematics (including set theory, number theory, and probability). William Binney is an outspoken critic of illegal domestic surveillance programs and is the creator of Thin Thread – a surveillance system that would protect US Citizens privacy rights.

Ray McGovern is a former Central Intelligence Agency (CIA) officer turned political activist. McGovern was a CIA analyst from 1963 to 1990, and in the 1980s chaired National Intelligence Estimates and prepared the President’s Daily Brief. He received the Intelligence Commendation Medal at his retirement, returning it in 2006 to protest the CIA’s involvement in torture. McGovern’s post-retirement work includes commenting for Consortium News, RT, and Sputnik News, among other outlets, on intelligence and foreign policy issues. In 2003 he co-founded Veteran Intelligence Professionals for Sanity (VIPS)

Meryl Nass is an internal medicine physician who is the first person to have shown that an epidemic ascribed to natural causes was due to biological warfare. This involved the use of anthrax during the Rhodesian Civil War. She has testified to 7 Congressional committees on anthrax, biodefense, vaccines, Gulf War Syndrome. She has written widely on the anthrax letters, Ebola and the Swine Flu and Covid-19 pandemics.

Dr. Graeme MacQueen is a retired professor of religious studies at McMaster University, Ontario where he taught from 1974 to 2003. He was also the founder and director of the Centre for Peace Studies at McMaster, which was active in several war zones. He has served as a co-editor of the Journal of 9/11 Studies, an organizer of the Toronto Hearings on 9/11, and a member of the 9/11 Consensus Panel.

NYFD Commissioner Chris Gioia, a 30-year member of the Franklin Square and Munson Fire Department, has served as Chief from 2007-2012. He is also a veteran of the Marine Corps as well as an EMT for 25 years.

The separation of powers becomes a meaningless cliche as Alexander Charns – using the Federal Bureau of Investigation’s own files – reveals how that agency undermined the independence of the U.S. Supreme Court for a half-century. FBI director J. Edgar Hoover’s goal was simple: to push the Supreme Court to the right on issues of civil rights and criminal law. His techniques ranged from illegal wiretapping to spreading disinformation, from using Justice Abe Fortas as an informant to trying to hound liberal Justice William O. Douglas off the bench. Cloak and Gavel, the definitive work on the FBI-Supreme Court relationship, is based on thousands of pages of FBI documents that Charns fought for eight years to obtain. One 2,000-page file was released only after he filed hundreds of Freedom of Information requests and brought lawsuits against the FBI. It establishes Hoover’s strategies to influence the Senate confirmation process, incite the public against the Warren court, lobby for legislation to counteract judicial rulings, and use numerous informants inside the Court to both monitor and influence it. Charns was given special permission to conduct research using Justice Abe Fortas’s papers, which had been sealed until the year 2000. These papers proved Fortas had acted as an informer for the White House and for the FBI during his tenure on the bench. Fortas ultimately left the Court in disgrace after an ethics scandal unrelated to his informant role. Charns also suggests that Hoover’s death did not end the FBI’s attempts to influence Congress and the federal judiciary – as evidenced by the role of the FBI in the explosive Clarence Thomas-Anita Hill Senate hearings in 1991. Until now, no one has examined the ultimate constitutional violation – the FBI’s attempts to influence the Court by any means available.

We hope you’ll be joining us tomorrow night for the last teleconference of 2020.
 
Our first speaker will be Alison (“Sunny”) Maynard. She has been licensed as a lawyer in Colorado since 1987 and was the 2002 Green Party candidate for Colorado Attorney General. Often litigating against developers and governments she took many
cases pro bono to vindicate the public interest, uncovering criminal activity, including her
opponents’ collusion with judges. For exposing this misconduct she was targeted with a string of actions against her license to practice law by minions of the Colorado Supreme Court, without any client complaint, and was suspended three times. When illegally ordered to submit to a mental evaluation before she could be readmitted to practice, Sunny left Colorado.
 
In recent years she has, without compensation, assisted James Fetzer and Wolfgang Halbig in defending against lawsuits filed against them over their Sandy Hook research. As a result she has spent the last year defending against more bogus charges that she is “engaging in the unauthorized practice of law” brought by Fetzer’s litigation opponent Jake Zimmerman. In her talk, Sunny will assert that there has been a concerted, organized takeover and subversion of the judicial system in Colorado, and the U.S. generally.
 
Our second speaker is a long -time member of the teleconference, Paul Zarembka. Who will talk to us about Marxism and conspiracy theory — which is the subject of the final chapter of his new book, Key Elements of Social Theory Revolutionized by Marx with its last chapter entitled “Marxism, Machiavellianism, and Conspiracy Theory.”  His prior books include The Hidden History of 9-11.
 
Paul earned his PhD from the University of Wisconsin, Madison and was at the University of California, Berkeley, before joining State University of New York at Buffalo where he is now professor of economics. His initial research and teaching were in the neoclassical economic theory and in econometrics. Re-thinking the basis of theory and with almost three years at the International Labor Office in Geneva, Switzerland, he came to realize that a class-based approach to society, rather than an individualistic one, is required. Concluding that Marx offered the foundation needing to be built upon, since 1977 he has edited Research in Political Economy, a hardback annual.

Members of Congress Profited From COVID Bailout While Small Businesses Were Shut Out

As members of Congress pat themselves on the back for passing a new coronavirus relief package after a nine-month impasse, Americans can count on less money in the form of stimulus checks and unemployment insurance than they did in the spring, when Congress passed the Coronavirus Aid, Relief, and Economic Security Act (CARES Act)—and took advantage of it themselves.

A Sludge analysis of COVID bailout data found that companies at which 28 members of Congress or their spouses hold positions received at least $27 million in loans likely to be forgiven under the CARES Act.

The revelation that so many members of Congress personally benefited from the Paycheck Protection Program (PPP) and Economic Injury Disaster Loans (EIDL) authorized by the CARES Act comes as Congress must consider how to address President Trump’s Tuesday night demand that all Americans be given $2,000 stimulus checks, after their Monday night bill cut in half unemployment insurance and stimulus checks for Americans compared to an earlier House proposal. President Trump criticized the bill but fell short of saying he’ll veto it; Congress appears to have enough votes to override a veto. On Thursday morning, House Republicans blocked Democrats’ attempt to increase stimulus check payments from $600 to $2,000.

Sludge found that 18 congressional Republicans and one Libertarian have received $21.7 million for 38 businesses with which they are associated. Nine Democrats received $6.1 million for 11 of their own businesses. An additional roughly $54 million went to nonprofits, think tanks and policy institutes, congressional caucuses, and higher education institutions tied to members of both parties.

While the majority of Democrats and Republicans voted to pass Monday’s COVID relief package, two Democrats and 57 Republicans voted against it. Among the Republicans who voted to not fund a second round of PPP, among other provisions, are 10 who received $15.3 million in PPP loans from the CARES Act. “The opportunities for corruption and scandal are particularly ripe when the business interests of members of Congress and other government officials go to the trough for public funds from programs they helped design,” said Craig Holman of Public Citizen, a non-partisan government watchdog. “Like the larger business that…reaped the greatest rewards from the PPP program, government officials themselves have inside knowledge of how the application process works and who to contact for the public assistance. Even if no deliberate favoritism is involved, the optics of potential self-dealing alone undermines public confidence in these programs.”

Rep. Brett Guthrie (R-Ky.) was one of the members who voted nay on Monday night. He also benefited from PPP funding when his family’s business received $4.3 million in loans that most likely will not have to be repaid.

Along with many other Republicans, Guthrie had decried stimulus spending aimed at ordinary workers and individuals who do not earn six digit salaries. In July, Guthrie, PPP recipient Rep. Ralph Norman (R-S.C.) and 33 other GOP representatives wrote to President Trump and implored him to stop extended unemployment benefits from reaching jobless Americans in the spring and summer. Extending the additional $600 in weekly unemployment checks would “only slow our economic recovery,” the lawmakers wrote.

It is not illegal or against House and Senate ethics rules for members to hold positions outside their duties in Congress—and many do, while simultaneously crafting legislation that will help those companies, Sludge found in July.

While the loans to lawmakers certainly are helpful for their businesses, some of the biggest financial assistance from the CARES Act likely comes in the form of tax relief for so-called “pass through” business entities, such as LLCs. It is common for members of Congress to be affiliated with or invested in such companies, Sludge’s analysis shows. Provisions in the CARES Act allow for such companies to receive an immediate refund on losses from prior years and other lucrative tax deductions that amount to a windfall. The biggest winners will be “the roughly 43,000 taxpayers with $1 million or more in annual income [that] will reap 82 percent of the benefits and get an average tax cut of more than $1.6 million,” according to tax expert Steve Rosenthal.

Congress could have targeted relief to the small businesses who need it most rather than millionaires and large businesses, Rosenthal argued. Of all the private companies members of Congress are associated with, the majority—205 of 347—are LLCs, according to Sludge’s analysis.

Mysterious Dark Money Group That Backed ‘Big Oil’s Favorite Democrat’ Was Funded by Big Oil

In the final weeks before voters in Texas’ Twenty-Eighth Congressional District went to the polls in the Democratic primary between incumbent Rep. Henry Cuellar, one of the most conservative House Democrats, and progressive challenger Jessica Cisneros, a brand-new “dark money” group dropped hundreds of thousands of dollars worth of ads to boost Cuellar.

The shadowy group, calling itself American Workers for Progress, spent more than $720,000 on television ads and mailers promoting Cuellar’s work on health care issues. The group’s ads, in both Spanish and English, don’t specifically advocate for Cuellar’s re-election but instead tell voters to call him to say thank you, a move that allowed it to avoid reporting information about its activities to the Federal Election Commission. Its website contains no information besides a generic-sounding statement about “addressing economic challenges.”

Despite its name, American Workers for Progress is not affiliated with labor groups, and despite the content of its ads it does not have ties to health care advocates. According to tax documents reviewed by Sludge, it is heavily funded by the oil and gas industry, having received $1.3 million from the American Petroleum Institute in 2019.

Koch-Funded Group Seeks to Overturn Voter-Approved Tax on Arizona’s Wealthiest 1%

Arizona is one of 26 states where citizens can initiate legislation through a ballot initiative, and in 2018, residents launched a ballot campaign to bolster resources for public education. The state’s education funding had seen over $1 billion in cuts over the previous decade. According to the National Education Association, Arizona had the eighth-lowest average teacher salary of states, at $47,403.

Supporters of increased education funding undertook a ballot measure that would have raised $690 million more per year for schools through a tax increase on the state’s wealthiest 1% of taxpayers. But while the measure gathered enough qualifying signatures, it did not make it to the ballot that year—the Arizona Chamber of Commerce brought a technical challenge to its wording, after corporations kicked in over $1 million to its campaign opposing the measure. The Arizona Supreme Court ruled 5-2 in August 2018 that a public pamphlet should have used the words “percentage points” rather than the percent symbol, among other issues.

Behind the Arizona Supreme Court’s ruling, reporters Scott Zimmerman and David Armiak found at Exposed by CMD, was a 2017 bill passed by Republicans that required a “strict compliance” legal standard for ballot initiatives. That law signed by Gov. Doug Ducey, in turn, had been supported by the right-wing Barry Goldwater Institute for Public Policy Research, an advocacy group that has received funding from the Koch network, the Bradley Foundation, and other major conservative funders.

Richard Neal Got a Surprise Billing Deal for His Private Equity Donors

After House Ways and Means Committee Chairman Richard Neal (D-Mass.) blew up a bipartisan deal to fix surprise medical billing last year that his private equity industry donors opposed, congressional leaders have endorsed a new proposal, and Neal is on board.

The backroom deal was announced Friday night between four congressional committees: the House Energy and Commerce Committee, House Education and Workforce Committee, the House Ways and Means Committee, and the Republican-led Senate Health, Education and Labor Committee. Their plan, which has the blessing of Nancy Pelosi and Chuck Schumer, is to circumvent the legislative process and attach it to the year-end omnibus that must be passed to keep much of the federal government functioning.

The proposal will eliminate most of the expensive bills that get sprung on people when they are unknowingly treated by an out-of-network anesthesiologist, emergency room physician, or other health care provider at an in-network hospital. But Neal got some concessions that will help medical staffing companies, including those owned by private equity firms like Blackstone Group and KKR, maintain many of the profits they have been making by springing giant bills on unsuspecting patients. The cost of the savings Neal secured for the staffing firms will be absorbed by the health insurance companies, which will almost certainly respond by jacking up premiums a bit for everyone.

The Model Emergency Health Powers Act Creates Its Own Emergency
THIS IS NOT A HEALTHY PIECE OF LEGISLATION

April 8, 2002 - One year ago, the Centers for Disease Control began negotiations for a model piece of legislation that would help states deal with a bioterrorism epidemic. Why focus on the states rather than the federal government? Because control of the practice of medicine is regulated at the state, not federal level. Some emergency responses are also handled at the state level, such as disasters in which the national guard (really a state militia) is called to assist. Other preparations for emergencies are made at the federal level.

The CDC negotiations concluded rapidly after September 11, and Georgetown and Johns Hopkins University Professor of Law and Public Health Lawrence O. Gostin received a CDC contract to write and do public relations to help pass such a bill in every state. He says, "America is experiencing a tragedy of unprecedented proportions, but there is one silver lining: the political community is coming together with a clear determination to protect the civilian population from harm."

The silver lining for him was a $300,000 per year contract for up to three years for his services.

By October 30 (was it a trick or a treat?) the first version of the Model Emergency Health Powers Act was unveiled, and presented to every governor and state legislature for review. Outside the halls of government, the bill bombed. A wide variety of pundits blasted its unprecedented incursions of our civil liberties. George Washington University Law Professor Jonathan Turley points out that "what the Act does not mention is that governors in most states already have all of the authority contained in the Act."

The bill allows a governor to declare an emergency on almost any infectious basis (emergencies are loosely defined in the bill) — and once declared, would then give the governor "unchecked and unfettered power," according to Turley. He also notes, "What is most astonishing is the triggering of this absolute authority is left entirely to the discretion of each governor."

According to Jennifer King, Director of the Health and Human Services Task Force of the American Legislative Exchange Council, "Most unusual is the fact that there are no provisions for judicial or legislative review of the emergency declaration. In fact, the legislature is pointedly prohibited from reviewing the declaration for 60 days."

She also points out the bill’s "blatant disregard for personal privacy and individual liberties... All information gathered by medical professionals and pharmacists [must] be reported to public health authorities," who may share it with "persons who have a legitimate need," including law enforcement authorities. But ‘legitimate need’ is not defined.

That is only the beginning. The bill further gives the authorities the right to seize or destroy property, food, medicines, firearms, etc. Citizens can be subjected to medical examinations and treatments against their will. The bill’s first draft made refusal of medical care a misdemeanor! In addition to compulsory acceptance of medications and vaccinations, citizens can be forcibly quarantined. According to Jennifer King, "public health authorities may determine who gets what drugs when, ‘without any additional legislative authorization.’"

Dr. Jane Orient, Executive Director of the Association of American Physicians and Surgeons, has pointed out what should be an obvious problem: "Public health officials are not omniscient." For example, "They were silent as the WHO destroyed tens of millions of smallpox vaccine doses in the 1990s for want of $25,000 per year to buy electricity for the storage freezers." More recently, CDC made a number of poor decisions when it came to handling the anthrax crisis.

Dr. Orient sums up what the Act provides, compared to what would really be needed in an actual emergency: "In improving emergency preparedness, States should emphasize abilities to mitigate the situation, not powers to seize, commandeer, coerce, punish and disrupt. Better laboratories with surge capacity; stockpiles of vaccine, drugs, medical equipment and supplies; protective gear; decontamination equipment; and improved training of both officials and citizens would all be very helpful, but are not part of the Emergency Health Powers Act."

FBI SNITCH SENTENCED TO LIFE 

In the series of trials which followed the capture of the Ohio 7, the government relied heavily upon the testimony of an informant named Joseph Aceto (aka: Joseph Balino), a former member of Statewide Correctional Alliance for Reform (SCAR), a prisoners-rights organization founded in Portland, Maine during the early 1970s by Tom Manning and Ray Luc Levasseur.  Aceto offered considerable "evidence" concerning the original formation of the SMJJ, its evolution into UFF, and supposedly first-hand recollections of the defendants' having described their bombing and bank-robbing exploits to him. Only later did it emerge conclusively that the government's star witness had consistently lied under oath, passing off third-hand gossip and utter fabrications as conversations in which he himself had participated.   It also came out that Aceto had been diagnosed as psychotic and administered heavy doses of the tranquilizer Mellaril - to "increase his veracity" - prior to testimony.   To top things off, it was revealed that, in exchange for such testimony, the FBI had arranged for him to be released from prison where he was serving a life sentence for a brutal stabbing murder and placed on the federal witness protection program (a package with an $800 per month stipend).   All this information had been withheld from the defense - and consequently from the jury - at trial.

A Deputy Alabama Attorney General, who committed suicide last Nov. 5th was being harassed by two FBI agents who mistakenly thought he was trying to help Milton McGregor.
Officials in the AG’s office confirmed that fact and also the tragic self-inflicted death last December after the The Independent submitted questions to them. The agents, both involved in the investigation of McGregor and the current gaming legislation issue, were Keith Baker and John H. McEachern, III.


The Deputy AG, Robert William “Bob” Caviness, was in the process of conducting a background check on an individual with the last name of McEachern, who lived in the Auburn-Opelika area. It was a matter involving worker’s comp fraud.
The Independent was told by the AG’s office that Agents Baker and McEachern became suspicious when they found out through the state’s computer data base that someone in the Attorney General’s office was conducting the search involving McEachern’s name.

The body of a missing retired FBI agent was found in Waller County, Texas late last week near her car, the Waller County News Citizen reported.
The paper said unconfirmed reports indicated Patricia Durney had suffered a bullet wound to the head. It said authorities were trying to determine whether it was a homicide or suicide. Her body was found Thursday, one day after she was reported missing.
A comment from the sheriff’s department made it sound as if they were leaning toward suicide.
