THE LEGACY OF THE SIXTIES: Military Industrial Complex killed Kennedy to prevent him from ending the Cold War

On June 10, 1963, President John F. Kennedy gave a speech at American University calling for an end to the nuclear arms race. This speech got more coverage in the Soviet Union than in the USA.
On September 20, 1963, at the United Nations General Assembly, JFK offered to convert the “Moon race” into a cooperative effort with the Soviet Union.
JFK’s change of approach on the Moon race was part of an effort to end the Cold War, the reason the military industrial intelligence media financial complex removed him from office.
What would “The Sixties” have been if JFK’s order on October 11, 1963 to start the withdrawal from Vietnam had been implemented? What would the world be if the Cold War had ended in JFK’s second term, as planned, freeing up resources for peaceful purposes? What society would we live in today if we had chosen global cooperation instead of endless warfare? Would we have used our creative talents for something better? Would warnings about ecological destruction have been heeded? What positive lessons can we learn from this missed opportunity, as nations fight over finite resources?

A police union is asking the California Supreme Court to block the release of internal officer investigations before a new state law takes effect next year.

The San Bernardino County Sheriff’s Employees’ Benefit Assn. filed a petition Tuesday asking justices to rule that only investigations of incidents that occur after Jan. 1 would be available under the law — and not those the department has on file from years prior.

The litigation comes after this year’s passage of Senate Bill 1421, which opens to the public for the first time internal investigations of officer shootings and other major uses of force, along with confirmed cases of sexual assault and lying while on duty. The

Shortly after the "Muhammad Art Exhibit" event was announced in early 2015, the undercover agent who had been infiltrating the small cell of radicals texted Simpson, saying, "tear up Texas."

Additionally, the undercover agent was in a separate car directly behind Simpson and Soofi when they opened fire and had been taking pictures of the attackers' car just seconds before the shooting began.

When the first shots were fired, the undercover agent fled his own vehicle, but was apprehended by local police, at which point the agent told police he was undercover with the FBI.

F.B.I. Wiretap Recorded Suspect on Eve of Bike Path Terror Attack


The Uzbek man charged with using a truck to kill eight people on a Manhattan bike path last year was recorded on an F.B.I. wiretap the day before the attack and was heard on other calls going back three years, according to two court filings by defense lawyers.

The filings do not reveal the contents of the conversations or whether the man, Sayfullo Saipov, 30, was overheard making threats or talking about an impending attack. Still, the filings suggested that Mr. Saipov was in touch with other people under F.B.I. surveillance

Jake Braun, the CEO of Cambridge Global Advisors, helped organize the Vote Hacking Village at this year's DEFCON, the world's largest convention of hackers. Over the course of three days, hundreds of them scanned, manipulated and sabotaged nine different types of actual voting equipment.
"This is not make believe," he said during interview in Las Vegas. "This is stuff that's actually happened."
Brad Evans, a hacker who tried to exploit one of the pieces of voting equipment at DEFCON, said that he was doing so because, "I want to help secure these things."
Among the flaws hackers at DEFCON say they found:
* A voting scanner and tabulator -- still used in up to 24 states, according to the group Verified Voting -- with no password or software verification to prevent it from being overridden,
* A touchscreen voting machine that hackers reprogrammed to play music and animated clips.
* An electronic poll book machine that signs in voters on Election Day hacked in five seconds, potentially exposing "unencoded" personal information on voters.
Even though 100 local election officials came to DEFCON, the National Association of Secretaries of State, in a statement the day before the event began, criticized the hacking as a "pseudo environment" that "in no way replicates" accurate protect

A former F.B.I. agent who pleaded guilty to taking kickbacks from a pepper-spray manufacturer was sentenced on Friday to two months in Federal prison.
The former agent, Thomas W. W. Ward, 49, the bureau's former chief of pepper-spray testing and research, was sentenced to two months in prison and three years' probation.
In pleading guilty to one count of accepting an unlawful gratuity, Mr. Ward admitted taking $57,500 in kickbacks from a pepper-spray manufacturer.

BATON ROUGE, La. – A district court improperly dismissed an officer’s negligence claim against the organizer of a 2016 Black Lives Matter protest in Baton Rouge, the Fifth Circuit ruled. The officer alleges the organizer led demonstrators onto a highway and provoked an altercation between police and protestors, causing the officer’s injuries. 
The officer has sufficiently alleged that his injuries were the result of organizer DeRay Mckesson’s “own tortious conduct in organizing a foreseeably violent protest.”

WASHINGTON -- The former chief internal watchdog at the FBI has pleaded guilty to sexually assaulting a 6-year-old girl and has admitted he had a history of molesting other children before he joined the bureau for what became a two-decade career.
John H. Conditt Jr., 53, who retired in 2001, was sentenced last week in Tarrant County Court in Fort Worth to 12 years in prison after he admitted he molested the daughter of two FBI agents after he retired. He acknowledged molesting at least two other girls before he began his law enforcement career, his lawyer said.
Conditt sought treatment for sex offenders after his arrest last year, said his attorney, Toby Goldsmith.
"The problem these people have is they don't really feel like it is their fault," Goldsmith said. "The treatment doesn't work unless you admit you are the one who instigated it, and he did that."
Conditt headed the internal affairs unit, which investigates agent wrongdoing, for the Office of Professional Responsibility at FBI headquarters in Washington from 1999 until June 2001, the FBI said.
FBI officials said yesterday they had no information suggesting Conditt had any problems during his career and he was never the subject of an investigation. Assistant District Attorney Mitch Poe of Tarrant County, who prosecuted

In this week’s FOIA round-up, the Department of the Interior staff emails show employees were interested in the Federal Bureau of Investigation’s “500-page per month” policy, the Associated Press created a new dataset by collecting information from each state to see why people wanted a medical marijuana card, and an Arkansas judge rules that a clerk broke state public-records laws, but cites as extenuating circumstances the clerk was acting on advice that they had received from state judicial authorities.

Internal emails show that Department of the Interior employees looked to the FBI’s FOIA policies as a potential solution to the increase in number of requests. Rachel Spector, an official with Interior’s Office of the Solicitor, wrote to an FBI official seeking information on their procedures in an email stating, “Sorry to be so persistent, but we are scrambling to get our arms around a significant surge in FOIA requests.” Spector also referred to the Bureau’s FOIA program as “the gold standard.”

# FOIA template structure
All content after the version number line above, except for the contact details at the very end, is part of my standard FOIA request template and identical between all of my FOIA requests. The provisions below are generally applicable to all FOIA / Privacy Act requests that I make.
There is one exception: the contact details below my signature at the very bottom (provided by MuckRock) are different for each request. Please use the distinct contact details matching each request, to ensure that your responses are correctly tracked.
The template provisions specify e.g. additional requests relating to my FOIA/PA requests themselves, form and format, timing, redaction & review, rolling updates, § 508 compliance, identity, fee waiver, my identity, and the like. They apply to this request, but are not specific to it.
If anything in the request-specific section above explicitly overrides anything in this template section, the request-specific section controls. If there is any ambiguity about such an override, please ask me for clarification.
The version number above is provided to make it easier for you to process my requests. "All parts of the record" means that the "record" should be considered to be the most comprehensive record with any responsive portion. For instance:
a) if any portion of an email is responsive, the entire contents of all email thread(s) to which that email belongs is also responsive (including attachments);
b) if a record is part of a larger record, such as a responsive table that is in a chapter of a report, then the entire larger record (e.g. the full report) is responsive, together with any appendices, amendments, etc.;
c) if a record is part of a book, the entire book is responsive;
d) if a record is part of a database, all related database records are responsive;
etc.
"Related database records" has the technical meaning used in relational database management systems (such as SQL). It recursively includes all directly and indirectly related records (starting with all responsive records, include as responsive the full row of each, and recursively include as responsive all rows for which any responsive record has a foreign key or is referenced by a foreign key), together with the schema for all responsive records.
Items in part (D) should be prioritized at the same level as the record they apply to.
# Timing
For all requests above, the "cut-off date" is, at the earliest, the date that you conduct the search.
The priority order listed above is only for items that may take extra time to respond to, and must not be taken as blocking response to an otherwise lower priority item that could be released more quickly than a higher priority item that is pending time-intensive search or review.
# FOIA IA notice
Please note that this request is made after the enactment of Public Law No. 114-185, S. 337 (114th), the FOIA Improvement Act of 2016 (FOIA IA). The revised statute, as specified in the FOIA IA, applies to this request. FOIA IA § 6.
In particular, please note that:
1. you must provide electronic format documents, §§ 552(a)(2) (undesignated preceding text), 552(a)(2)(E) (undesignated following text), 552(a)(3)(B), and 552(a)(3)(C);
2. you may not specify an appeal duration less than 90 days, § 552(a)(6)(C)(A)(i)(III)(aa);

For the purposes of this request, except as otherwise specified, "record" means any agreement, appendix, application, assessment, attachment, checklist, circular, contract, correspondence (including but not limited to email), data management plan, documentation of search parameters, email, email attachment, form, guide, handbook, index of records, information consent agreement, information sharing agreement, instruction, interpretation, kit, management instruction, manual, memorandum, memorandum of understanding, notice, notification, opinion, order, plan, policy, policy statement, processing note, publication, recording, referral, report, request certification form, request detail report, response, rule, script, standard operating procedure, submission, talking point, training document, video, or related record described, regardless of publication status.
# Anti-duplication exclusion
This request specifically excludes providing me with new copies of any records which have been already provided to me or published online for free (e.g. on the agency's online "reading room"), in full or identically to the form that would be provided to me under this request (i.e. with exactly the same format, redactions, and claimed exemptions).
This is only an exclusion on providing records under this request that are identical to those already provided to me or available online, and only if I am or have already been provided a link to the online version (if "available online").
This exclusion is only intended to limit unnecessary duplication or provision, not to limit what records are responsive to this request, nor to permit failure to disclose the location of a responsive record available online. If this exclusion would in any way increase the cost or duration to respond to this request, it is to be ignored to the extent it does so.

# Minimal redaction
Please note that the FOIA requires you to service the maximum extent of my request that can be done via e.g. partial redaction of exempt material. If you believe some portions of a record to be exempt because it contains Sensitive Security Information (SSI, 49 CFR 15 & 1520) or classified information (18 USC 798), please provide a version of the record redacted to the minimum extent necessary to remove exempt information (e.g. per 49 CFR 1520.15), along with adequate information to describe the reason for each specific exemption.
## Redaction of repeatedly occurring content
When redacting any content that appears more than once in the full set of responsive records, please assign a replacement identifier for each, so that your redaction does not obfuscate the commonality.
For example, suppose that responsive records include the names Alice, Bob, Charlie, and Diego, and you determine that each of those names are redactable (e.g. under (b)(7)(C)). Rather than redacting each with only the text "(b)(7)(C)", replace each instance of "Alice" with "(b)(7)(C) - Person 1", each instance of "Bob" with "(b)(7)(C) - Person 2", etc. This e.g. withholds Alice's identity while not withholding the fact of commonality between occurrences.
Please use reasonably descriptive identifiers. For instance, if Elizabeth's name is not redacted but her personal cellphone number is, and that cellphone number appears e.g. both in her email signature and elsewhere by itself, it should in both cases be redacted with the same descriptive identifier, such as "[Alice's cell #]". For documents, this can be specified in the margins. If space or file format does not permit you to do so, then please use a short code (e.g. "[#52]", and provide a table matching codes to full identifiers in your response letter.
If you make any such redactions, please keep but do not provide a table matching codes/identifiers to the redacted content, for use in case your redaction is examined or overturned on appeal or in litigation.
This is a form and format request pertaining to your process of redaction. Because it only applies in situations when you have already exercised the voluntary decision to alter the records from the original form requested, you have necessarily waived any objection to this section "creating a new record", since your act of redaction itself already "makes a new record" in that limited sense. This is only about how you do a redaction you have already decided to make.

“It affects me,” said Turner, a two-time FBI whistleblower. “I have PTSD from my experience. It’s just brutal. I don’t know any other way to put it. It’s brutal.”
She says the retaliation she experienced after reporting wrongdoing in the FBI is common among hundreds of government whistleblowers. She fears the same will happen to the individual whose complaint that Trump pressured a foreign government to investigate a political rival is now at the heart of a House impeachment inquiry.
Retaliation wasn’t on Turner’s mind in 1998 when she first reported wrongdoing to her supervisor. “I went down there with the idea that he would right a wrong,” she said.
In her work as the senior resident agent — the first woman in the FBI to hold that position — over a 25,000-square-mile region in North Dakota, Turner had learned of a violent rape on an Indian reservation that another agent had closed as a car accident. She reopened the case, which led to a conviction, and found in her investigation that the same agent had closed a number of child abuse cases, some ending in death, in similar fashion.
Turner traveled from Minot, North Dakota, to the Minneapolis field office and shared her findings with the special agent in charge. His response was not what she expected. “You have a kid of your own to worry about,” she recalls him saying. She took it as coded advice to ignore the situation, but his words troubled her on the r

Now, that’s a mouthful of alphabet soup. So, here’s a bit a backstory.
In October 2018, BuzzFeed News reporter and FOIA expert Jason Leopold filed FOIA requests for the following FBI documents: (1) “A copy of the final report sent to the White House and the Senate Judiciary Committee on either October 3 or October 4, 2018 on Supreme Court nominee Brett Kavanaugh”; and (2) “All interview notes; investigative notes; FD-302s relating or referring to the FBI investigation into allegations leveled against Mr. Kavanaugh.”
At first, it seemed as if the FBI was keen to wash their hands of the Kavanaugh imbroglio–the agency uncharacteristically acknowledged the request and assigned it for expedited processing on the same day the Kavanaugh document request was filed. Then came the stonewall.
A month passed and the FBI produced zero responsive documents.
According to the FOIA lawsuit filed by Leopold and BuzzFeed in November 2018: “In addition to granting expedited processing, that same day [the FBI] also informed [Leopold and Buzzfeed] unusual circumstances applied to the processing of the [Kavanaugh] Request.”
Nearly one year of legal wrangling followed. On Friday, the FBI moved to have the case dismissed by arguing that they’ve already released enough information and that what they haven’t yet released is covered by one of the several statutory exceptions to FOIA.
What’s been released isn’t exactly a documentary treasure trove.

NSA Official Refuses to Reveal the Success — or Failure — of Phone Surveillance

Members of the Senate Judiciary Committee from both sides of the aisle are questioning the necessity of renewing one of the NSA’s many telephone surveillance programs.
During a hearing on Wednesday, Republican Lindsey Graham of South Carolina and Democrat Dianne Feinstein of California each peppered an NSA representative regarding that organization’s drive to continue its unconstitutional collection of Call Detail Records (CDR) of Americans, records that reveal personal data of millions of citizens.
The Hill offered the following summary of the surveillance program being debated:
The call detail records program gathered information on incoming and outgoing domestic text messages and phone calls to aid the government in terrorism investigations. Civil liberties advocates are pressing Congress to allow the program to sunset entirely, claiming that privacy concerns outweigh any national security benefits.
"Why should we reauthorize it?" Graham, the chairman of the Senate Judiciary Committee, asked NSA official Susan Morgan.

The trickle of "Brady lists" continues, further enraging New York City's police unions. The last batch of cops considered too dishonest or crooked to be called on to testify in court led the Sergeants Benevolent Association to claim the Bronx DA's release of its "naughty list" was an attempt to "smear honest, hardworking cops."
It was a super-strange claim to make about cops that were too dishonest to be allowed in court, suggesting the SBA felt misconduct and perjury were just part of everyday police work. It's a stretch to call a list of cops even prosecutors don't trust a smear attempt. These reputations are already besmirched. The only difference is that the public now knows, rather than just Bronx prosecutors.
Another list of bad cops has been released to Gothamist. This one comes courtesy of a public records request sent to the Brooklyn DA's office.

Fifty years ago, C. Wright Mills completed his trilogy on American society with the publication of The Power Elite, which encompassed, updated, and greatly added to everything he had said in The New Men of Power (1948) and White Collar (1951). The book caused a firestorm in academic and political circles, leading to innumerable reviews in scholarly journals and the popular press, most of them negative. Bristling with terms like "the warlords," "the higher immorality," "the power elite," "crackpot realism," and "organized irresponsibility," it nonetheless contained a very large amount of research, much of it in the 47 pages of Notes. It became a classic because it was the first full-scale study of the structure and distribution of power in the United States by a sociologist using the full panoply of modern-day sociological theory and methods.
The Power Elite also broke new ground because it was one of the few critical studies of the American power structure inside or outside the academy that did not start with a class-struggle perspective, which caused it to be criticized as vigorously by Marxists as it was by liberals and conservatives. China, private industry, and adversaries abroad could all prosper at America’s expense if the federal government does not move to support and lead the direction of artificial intelligence, the National Security Commission on Artificial Intelligence said in a report released earlier this month.
More than 30 countries in the last five years have publicly committed to some nationwide strategic investment in AI capabilities. In February, President Donald Trump signed an executive order to prioritize the use and development of AI-based technologies across the government.
With a flurry of recent AI advances, there is growing pressure to set rules on how to proceed — along with raised stakes.
“We’ve gone through a few of these cycles now, and there’s at least some reason to believe that this time it might be the real deal,” said Ryan Budish, assistant research director at the Berkman Klein Center for Internet & Society. “There have been advances in large-scale datasets that enable more advanced AI. There’ve been breakthroughs in building AI systems. There have been advances in processing powers and GPU or custom silicon to enable more AI developments. I think that there is reason to think this time AI will have substantial transformative impacts. We’re already seeing that in some places.”
The NSCAI, created last year as part of the National Defense Authorization Act, has been studying AI’s potential to both advance and threaten U.S. national security interests. In reading Katy Burns’s column on Sunday, I am baffled that Trump continues to peddle the myth that the FBI conspired against him to help elect Hillary. “He’s also very exercised about the FBI, insisting – with no evidence whatsoever – that its leaders were in cahoots with Hillary Clinton’s campaign in 2016, hell-bent on getting her installed in the White House, and so did their devious best to sink the Donald’s candidacy.”
Two factors got Trump elected against very long odds. One was the meddling of Russian hackers – spreading fake news on social media and releasing DNC emails through the Putin agent, Julian Assange. Two was Comey announcing 10 days before the election that the FBI was re-opening the investigation into Hillary’s emails. Nate Silver estimated this cost Hillary about 3% in the polls. At the time Comey could have also let it be known that the FBI had been investigating the Trump campaign, which would certainly have hurt Trump, but chose not to. Trump should be kissing Comey’s feet and thanking him instead of attacking him.
It’s not enough to say that Trump is pushing his FBI conspiracy “with no evidence whatsoever.” The truth is that the FBI helped put Trump in the White House, but Trump doesn’t want his base to know that. You folks in the media need

Matthew Cecil received his B.S. in History from South Dakota State University in 1995. He then went on to Minnesota State University at Mankato to receive his M.A. in History. In 2000, he graduated from the University of Iowa with a Ph.D. in Mass Communication with a specialization in Publication Relations.
Cecil's career has includes experience as a political reporter and columnist, and a media relations practitioner in South Dakota and North Dakota. His teaching career started as a graduate teaching assistant at the University of Iowa. His first Assistant Professor position was a Purdue University in the Department of Communication from 2000-2002. He then took a position at the University of Oklahoma. In 2005, he moved back to his hometown of Brookings, SD and South Dakota State University. Dr. Cecil is now an Associate Professor and the Coordinator of the Media Production Emphasis in the Department of Journalism & Mass Communication. Dr. Cecil teaches a variety of courses including the department's introductory course, Introduction to Mass Communication, as well as basic video production, new media, and public relation skills.
Cecil's specialty area is new media and media history, but his expertise would be the FBI public relations during the J. Edgar Hoover era. Dr. Cecil's scholarly work has appeared in American Journalism, Journalism and Mass Communication Quarterly, The Journalism Inquiry, and other national and international journals.

In the course of his research over the last ten years, Associate Professor Matthew Cecil has used the Freedom of Information and Privacy Act to collect the J. Edgar Hoover-era FBI files of hundreds of prominent journalists. In all, Cecil has collected nearly 90,000 pages of FBI information. The files have provided the raw material for several scholarly publications and Cecil has several more, along with a book project, in the works.
The folders consist of photocopied files provided by the Federal Bureau of Investigation at the request of Dr. Cecil. The documents were reviewed under the Freedom on Information/Privacy Acts, Title 5, United Stated Code, Section 552/552a by the FBI. Deletions were made to protect information which was exempt from disclosure. A deleted page information sheet was inserted in the file to indicate where pages were withheld. These sheets will be found in the folders.

Join artist Robert Shetterly for a community session open to the public. The community session will pose the following question: What is the role of education in a democracy?

Robert will ask attendees to create personal quotes in response to their concerns and challenges related to this question. He will share why he creates the work that he does and the connection to the people depicted in his work. He will highlight practical examples from his previous workshops for how teachers can explore these questions with their students.

Robert Shetterly is an American artist, best known for his portrait series, "Americans Who Tell the Truth." Shetterly set out to paint Americans who inspired him. He initially intended to paint only 50 portraits, but by 2019 over 240 portraits can be found in the series. Portions of the series tour widely across the United States, being shown in schools, museums, libraries, galleries and other public spaces – including Thomas College.

A book titled "Americans Who Tell the Truth," written and illustrated by Shetterly, won the International Reading Association's Intermediate—Nonfiction award for 2006, and the nonprofit Children's Book Council listed it among the "2006 Notable Social Studies Trade Books for Young People.” Shetterly lives in Brooksville, Maine.

An FBI agent who shot and killed a Chihuahua named Sassy in front of his Texas home says he deserves probation.
Amazingly, if a judge approves, that’s the sentence he’ll get.
Lovett Leslie Ledger Jr., 40, who lives near Lorena, pleaded no contest to animal cruelty charges in exchange for a recommendation from prosecutors that he be placed on probation for two years, according to the Waco Tribune.
The 3-pound dog, which belonged to a neighboring 8-year-old girl, was shot in the neck, just above her rhinestone collar, in February of 2008.
A neighbor, who witnessed the shooting when she went to investigate why her dogs were barking, said Ledger shot the dog with a pellet rifle, as one of his children watched.
Ledger initially lied to investigators about the dog’s death but later told deputies he shot the animal, according to court records. Ledger and his attorney both declined

WHAT I AM DOING RIGHT NOW
My last memory of Washington DC was going over the White House fence and skinning my stomach on the steel barbs.  For that action I got one year’s probation but no jail time. Can you believe that? No fines either other than court costs because I lost my case. I had a great attorney named Mark Goldstone who taught me the fine art of defending myself in court.  I told him I was writing a book called “How to Be Your Own Damn Lawyer” and using his techniques. Now I haven’t done that yet, although I did write a screen play and included the court trial and Mark Goldstone who is a fine looking lawyer. Rob Lowe will play him.
The last I heard from that fine lawyer was that he was appealing my conviction on the grounds of  “who owns the air space over the White House fence?” For instance, can you stick your finger over the White House fence? Is that illegal? Now I believe the mailman who recently went over the White House fence and landed in a gyro-helicopter might want to check out those pleadings.  
Since that incident I have returned to Texas. Yes, I do live in Texas although many activists that I know and meet up with are soundly confused with that fact. I live very far in the country in a little fishing village that I don’t care to name.  In 2005 or 2006?  I had climbed the White House fence (this was the FIRST time) and two weeks later I got a visit from two guys in black suits with black shoes and wearing sunglasses.  They were Secret Service agents and wanted to know if I had an authority complex.  They next visited the elementary school for reasons I cannot fathom. They also visited my neighbor living in a trailer.  He was 80 years old and a card-carrying Militia and had a stash of weapons in his back room so they left pretty pronto.  
Since going over the WH fence in 2013, I have retired to a barn which I have recreated into a cabin. I painted it purple and did my own plumbing and cut my own firewood.  I am working to get totally off the grid.  I planted a garden in recycled window frames and have created the mother lode of tomatoes.  In the meantime, I am writing a book that is two years overdue about the lost cause of the fishermen.  I am also eyeballing a chemical plant’s waste water permit that the state of Texas has no inclination of letting me get involved in.  So you know what that means, doncha?

The Cincinnati Bell-FBI scandal:  Leonard Gates, a Cincinnati Bell employee for 23 years, testified that in the late 1970's and 80's, the FBI assisted telephone companies with hacking into mainframe election computers in cities across the country. He spoke with agents from both the DOJ (U.S. Attorney Kathleen M. Lewis and other skeptics of the vote-fixing scenario like to insist that there has never been any evidence of a "conspiracy" to fix elections by computer. But then, most of those we interviewed on both sides of the issue had never heard of the case of Leonard Gates of Cincinnati, Ohio. An employee of the Cincinnati Bell telephone company, Gates was watching a local t.v. news story, in which a Cincinnati man named Jim Condit was charging that the election system was vulnerable to vote fraud in the Hamilton county election process.
He based his charges on his experience as a candidate for city council in 1979, when, after an election night computer crash, Condit and seven other "feisty challengers" had suddenly "fallen to the very bottom of the heap" of 26 candidates. Gates called the station and later contacted Mr. Condit, telling him he knew firsthand how his votes were robbed. They met and shared information and ultimately Gates testified in Condit’s Cincinnatus PAC (political action committee) lawsuit against the Hamilton County Board of Elections.
The suit had earlier been decided against the plaintiffs and Gates took the stand during the appeal. He swore under oath that he was ordered by his Cincinnati Bell superiors to wiretap the election headquarters’ phones lines to provide a link-up between the county’s vote-counting computers and parties unknown on another phone line somewhere in California.
The following are excerpts from the Cincinnati Post of October, 30th, 1987:
Cincinnati Bell security supervisors ordered wire-taps installed on county computers before elections in the late 1970s and early 1980s that could have allowed vote totals to be altered, a former Bell employee says in a sworn court document.
Leonard Gates, a 23-year Cincinnati Bell employee until he was fired in 1986, claims in a deposition filed Thursday in Hamilton County Common Pleas Court to have installed the wire-taps. Cincinnati Bell officials denied Gates’ allegations that are part of a six-year-old civil suit that contends the elections computer is subject o manipulation and fraud.
Gates claims a security supervisor for the telephone company told him in 1979 that the firm had obtained a computer program through the FBI that gave it access to the county computer used to count votes. [Emphasis added].
The FBI refused comment and Cincinnati Bell spokesmen vehemently denied the allegations, claiming Gates was a "disgruntled ex-employee", yet, according to Condit, the company ultimately admitted that one of its vans was involved in the wiretapping, although it claimed they were commandeered without the company’s knowledge. The Post continued:
In the deposition, Gates claims he first installed a wire-tap on a telephone line to the county computers before the 1977 election at the instruction of James West, a Bell security supervisor.
Gates contends both West and Peter Gabor, security director, told him to install wire-taps in subsequent elections. Both men declined comment Thursday.
In the 1979 election, which is the focus of the deposition – Gates said he received instructions in the mail from West about installing wire-taps on county computers in the County Administration Building at Court and Main streets.
The wire-taps were installed on the eve of the election at Cincinnati Bell’s switching control center at Seventh and Elm Streets and terminated in a conference room in the building, Gates alleges.
In the deposition, Gates described in great technical detail installation of the wire-taps.
At about 8:30 p.m. on election day – Nov. 6, 1979 – Gates said he was called by West and told something had gone wrong, causing the elections computer to malfunction. At West’s instructions, Gates said he removed the taps.
The elections computer shutdown for two hours on election evening due to what was believed to be a power failure, Condit Sr. has said.
Gates said West told him they "had the ability to actually alter what was being done with the votes."
Gates said West told him the Board of elections did not know about the taps and that the computer program for the elections computer "was obtained out of California, and that the programming had been obtained through the FBI..."
Shortly after the 1979 election, Gates said he met with the late Richard Dugan, former Cincinnati Bell president, to express his concerns that the wire-taps were done without a court order.
"Mr. Dugan said it was a very gray area... This was just small compared to what was going on. He told me just, if I had a problem, to talk to him and everything would be okay, but everything was under control," Gates said [Emphasis added].
[Editor’s Note: This scandal’s alleged FBI connection raises the possibility of U.S. law enforcement and/or intelligence involvement in electronic vote-rigging.]
Another Cincinnati Bell employee, named Bob Draise, admitted to being involved in a second phase of the illegal operation, which involved wiretapping several prominent Cincinnati political figures including a crusader against pornography named Keating and the Hamilton County commissioner, Allen Paul.
Jim Condit told Relevance that, as a result of the ensuing scandal, Draise was convicted and five Cincinnati police officers, who were allegedly involved in the wiretapping operation, abruptly resigned. The alleged involvement of the FBI was never pursued and the Bureau

A police sergeant who has been granted limited immunity from prosecution has testified that the police intelligence unit worked closely with Cincinnati Bell to perform illegal wiretaps and that the illegally gained information was shared with the FBI and other agencies, including the Internal Revenue Service.
The police intelligence unit even was supplied with Cincinnati Bell equipment, including a Bell truck, so that policemen who were capable of performing wiretaps could perform them on their own, he said.

The results of their investigations were published in a range of newsletters and journals in articles which frequently cross-cited each other and often traced back to unsubstantiated charges of communist subversion made by persons testifying before congressional witch-hunting committees. · Young conservatives from colleges and universities were recruited and trained to participate in monitoring and analyzing the activities of alleged subversive groups through a network of interlocking conservative institutions based in Washington, D.C. · Information and documents collected by private right-wing groups were provided to government law-enforcement agencies that would otherwise be prevented from obtaining the information by constitutional and legislative restrictions. This biased and unverified information was then used to justify criminal investigations of dissidents in general and the anti-interventionist CISPES in particular.
Many activists involved in Central America issues became aware of ham-handed snooping by Federal Bureau of Investigation agents in the early 1980's.In 1986 the Center for Investigative Reporting in California used the federal Freedom of Information Act to obtain FBI files which suggested a large-scale probe into CISPES. In 1987 testimony by a former FBI informant Frank Varelli also suggested a broad attack on CISPES by the FBI. Varelli later told reporters of the involvement of other governmental and private right-wing groups in targeting CISPES.
Some 1300 pages of additional FBI files released in 1988 by New York's Center for Constitutional Rights (CCR), on behalf of CISPES, reveal in sharp detail the extent and nature of the FBI probe into CISPES. More importantly, the files show that the FBI, to justify its actions, accepted as fact a right-wing conspiratorial world-view which sees dissent as treason and resistance to oppression as terrorism.
The first FBI investigation of CISPES was launched in September of 1981to determine if CISPES should be forced to register under the Foreign Agents Registration Act. Among the documents used by the FBI to justify this CISPES probe, according to Congressional testimony by FBI official Oliver "Buck" Revell, was a 1981 article by a former FBI informant and ongoing right-wing private spy-John Rees. The Rees article appeared in Review of the News a magazine published by the paranoid ultra-right John Birch Society. This FBI investigation was terminated without indictments in December of 1981.
A second FBI investigation of CISPES began in March of 1983. It was premised on the right-wing conspiracy theory that CISPES was a cover for "terrorist" activity. To justify this view, the FBI relied not only on reports from its informant Varelli, but also in part on a conspiratorial analysis contained in a report written by Michael Boos, a staffer at the right-wing Young Americas Foundation. This FBI "counter-terrorism" investigation was terminated without indictments in 1985.
The FBI relying on the malicious musings of paranoid right-wing ideologues to justify probes of the anti-Administration CISPES is rather like the IRS assigning Jerry Falwell to audit the financial records of the American Civil Liberties Union

Lawsuit over bombing of Flight 103 dismissed

OKLAHOMA CITY — A federal judge has dismissed a libel lawsuit filed by a former FBI official who was alleged to have had advance knowledge of the 1988 bombing of Pan Am Flight 103 over Lockerbie, Scotland.
Oliver "Buck" Revell, a retired FBI associate deputy director, complained that a book, "The Oklahoma City Bombing and the Politics of Terror," accused him of allowing the mass murder of the 259 people on board the flight and 11 more on the ground.
The book, by David M. Hoffman, said Revell had prior knowledge of the bombing and pulled his son and daughter-in-law off the plane in London.
Revell said his son was briefly booked on the flight but had left London a week earlier. His daughter-in-law was in the United States.
Judge Robin J. Cauthron ruled Thursday that Revell had not shown that the author or his publisher knew the statements were false.

Carver Gayton & the "Dirty Little Rumor"
As readers of Probe should know, the FBI has always denied any formal relationship with Lee Harvey Oswald. This denial was upheld by both the Warren Commission and the House Select Committee on Assassinations. Still, there have been serious questions raised about this stance from the beginning. In a famous article in the January 27, 1964 issue of The Nation, Harold Feldman raised some very cogent questions about this point. In researching his recent book Oswald and the CIA, John Newman discovered an affidavit in the files of the Church Committee by one Carver Gayton. In this document Gayton had stated that he had met FBI agent James Hosty when Hosty had been transferred to Kansas City after the assassination. While there, Hosty had told Gayton that Oswald had been a PSI (Potential Security Informant) for the Bureau. While at the Rio Conference, Newman prepared a press release and faxed it to several press organizations. Reporter Sam Vincent Meddis picked up the release and wrote a story for USA Today. That story appeared at the top of page four in the August 30th issue of that national newspaper. In the article, FBI authorities stated that Gayton later denied that Hosty made the statement. This is true. Gayton told the HSCA in a June 1, 1977 interview that Hosty never told him anything at all about Oswald "and certainly not that LHO was an FBI agent." The problem here is that the Church Committee document was a sworn affidavit. The HSCA report is of an informal interview. There is no evidence that the HSCA ever confronted Gayton with his previous affidavit. It is interesting to note here that the lead that the HSCA was following on this interview was the same one that the Garrison investigation uncovered on Gayton. A man named Jim Gochenaur had written a letter to Garrison stating that when he was renting an apartment from Gayton, Gayton had told him the Hosty anecdote. In his interview with Howard Gilbert and Jack Moriarty of the HSCA, Gayton ridiculed Gochenaur by stating "he is somewhat of a flake and was an assassination buff".
Oliver "Buck" Revell
The article then quotes Oliver "Buck" Revell, former Bureau criminal investigations chief. In what must be termed "damage control", Revell states that "the PSI designation does not necessarily mean Oswald became an informant. It merely suggests that the FBI had an interest in possibly turning him into one because of his Marxist connections." This is the same "retired" FBI agent who wrote a fatuous response to the LaFontaine piece in the Washington Post on the John Elrod story. The same Revell who recently threatened legal action against PBS and author Diarmuid Jeffreys for charging him with cooperating with Oliver North in 1) Illegally harassing CISPES, a Central American support group favoring the Sandinistas, and 2) Assisting North's efforts to obstruct justice during the Iran-Contra Hearings. The same Revell who has become FBI point man on the Oklahoma City bombing, a case the FBI is already having problems with as questions about the explosives used and witnesses against suspect Timothy McVeigh now abound. It is important to note that Revell was also in charge of the FBI Dallas field office and became associate director from 1989-91.
In light of this information about FBI reluctance, seemingly led by "retired" higher-up Revell, it is relevant to quote Robinson's AP release: "The FBI has not yet specified reasons for keeping parts of the documents classified but is expected to stress the sensitive nature of work with foreign governments and the need to protect informants' identities" (emphasis added).
Although the Newman press release garnered the press coverage and framed the media debate, two other bits of evidence in this regard bolster the original contentions about Oswald by the critical community. Researcher Jeff Caufield has found a report on another HSCA interview with New Orleans FBI employee William Walter, mentioned by Jim Garrison in his book On the Trial of the Assassins. It seems that Walter, in a November 1977 interview, told HSCA investigators that Oswald was an FBI informant. Researcher Anna Marie Kuhns-Walko reportedly has also uncovered similar documents relating to an FBI agent who discovered the same and when FBI Director Hoover learned of this, "he hit the roof."
FBI on Trial
These indications of Bureau obstinacy in the face of the law – and possible obstruction of justice in the Kennedy case – could not have come at a worse time. The FBI is now under siege on several fronts. The new book Fatal Justice, on the Jeffrey McDonald murder case, has exposed the use of "professional" witnesses, a practice that goes back a very long time with the Bureau. The recent hearings on Capitol Hill concerning the shootings at Ruby Ridge bore a resemblance to the O. J. Simpson trial in a significant aspect. In the latter, LAPD officer and star witness Mark Fuhrman took the fifth amendment and refused to testify upon recall by the defense. In the former case, sniper Lon Horiuchi took the fifth before the Senate Committee investigating the Ruby Ridge shooting. His attorney was Earl Silbert, the original Justice Department lawyer involved in the Watergate investigation. Silbert was later replaced by special prosecutor Archibald Cox. A week later, four more FBI officials took the fifth in front of the same committee. The attorney for the four officials was Brendan Sullivan, the former attorney for Oliver North. In a further parallel, the chairman of the investigating panel was Arlen Specter. Specter allowed the five agents to invoke their privilege against self-incrimination in a closed session. He said there was no intent to "humiliate" them.
Making things even worse for the FBI's image are the revelations of former crime lab analyst Frederic Whitehurst. In an AP story carried nationwide and on an ABC "Primetime Live" segment, Whitehurst made the following startling revelations: 1) He was pressured to distort findings about the World Trade Center bombing to favor prosecutors. 2) In a Georgia bombing case investigated by current FBI Director Freeh, two agents slanted evidence by testifying about tests that weren't done and scientific conclusions they could not support. One of the agents, Roger Martz, testified in the Simpson case. 3) During one investigation, he was physically threatened by FBI bomb squad members to make false claims about evidence. 4) On one occasion, an FBI crime lab expert illegally adjusted a forensic testing device in order to alter the results the machine produced.
In a turn that will be familiar to all JFK researchers, when Whitehurst complained about these practices, nothing was done about his memos. Indeed the FBI's only reaction has been to declare Dr. Whitehurst's charges false and then demote him. At the end of the ABC segment, when reporter Brian Ross asked Whitehurst outside his home why he had gone public with the charges, Whitehurst, choking back tears, said that the proudest day of his life was when he became an FBI agent. On that day, he took an oath to uphold the Constitution. That oath did not include a clause to remain silent when other FBI agents broke the law. This genuinely moving moment will remind many readers of the transformation described by Kennedy researcher Bill Turner in his pioneering book Hoover's FBI.
In the face of all this, Director Freeh – while acknowledging the accusations as very serious – rejected suggestions for an outside panel review of the FBI. Even though opinion polls show that, in the face of these violent controversies, favorable opinions of the FBI have declined and negative perceptions have risen. To our knowledge, Freeh has taken no public position on the ARRB dispute with the FBI files. In a Los Angeles Times interview, the Director stated that 1) he regarded any matter that affected the FBI's credibility as serious, 2) that it was essential to acknowledge past mistakes, and 3) that firm action should be taken to correct wrongdoing. If Louis Freeh is serious, a good place to begin on all three is for him to take a public stand for openness on the Kennedy files.

Former FBI Special Agent Tyrone Powers, a veteran of the Maryland State Police, spent nine years as an FBI agent, with postings in Cincinnati and Detroit. He resigned in August 1994.The picture of the country's top law enforcement agency that emerges from Powers' eloquent prose reveals an organization beset by the same problems of racism that plague the rest of American society. Powers describes sheet-clad students at the FBI Academy impersonating Ku Klux Klansmen. He reports on FBI Agents in Detroit raising funds for white Detroit policemen charged with (and later convicted of) second degree murder in the death of Black motorist Malice Green. White agents on one occasion substituted the face of an ape on the photo of an African American agent's children, displayed on their Black colleague's desk.

White agents, according to Powers' narrative, urinated on photographs of President Bill Clinton and Vice President Al Gore. Powers provides eyewitness evidence of the agency's extralegal harassment of African American mayors Coleman Young (Detroit), Marion Barry (Washington, DC) and Harold Washington (Chicago).

Colorado becomes 22nd state to abolish the death penalty

          With Governor Jared Polis’s signature yesterday afternoon, Colorado became the 22nd U.S. state to abolish the death penalty and the tenth in the past decade-and-a-half. 
 
            Colorado’s action exemplifies the trend we are seeing in states across the country, which is a continuing movement away from capital punishment, first in practice, then in law. Half of U.S. states have either abolished the death penalty or have imposed moratoria on executions. Two thirds either no longer authorize capital punishment or have not executed anyone in more than a decade. New death sentences are down nearly 90% since the mid 1990s and executions have declined by 75% since the turn of the century. And more than 80% of U.S. counties have no one on death row and have not executed anyone in the past half century.
 
The trend away from the death penalty has been particularly strong in the West in recent years. Governors in Colorado, Washington, Oregon, and California have all halted executions. Washington and Colorado have gone on to judicially or legislatively abolish the death penalty and Oregon has significantly restricted its scope. No state west of Texas has carried out an execution in the past five years and fewer new death sentences were imposed in those states last year than in any year since California brought back its death penalty in the late 1970s.
 
That is not a surprise. Public support for capital punishment has been thinning and is near a generation low. America’s views of criminal justice have experienced a sea change and in state legislatures, the issue has become increasingly bipartisan. And as legislators have shifted from viewing the death penalty as an instrument of politics and have increasingly subjected it to the same type of scrutiny afforded other government programs, we have seen significant legislative movement towards abolition across the country.
 
Growing numbers of legislators have criticized the high cost of capital punishment, the inherent risk of convicting and executing the innocent, the continuing racial, geographic, and economic disparities in the way it is applied, and the untrustworthiness of states to carry it out fairly, consistently, or in a principled manner. As Governor Polis noted in his statement today, “the death penalty cannot be, and never has been, administered equitably in the State of Colorado.”
 
            Colorado’s legislators engaged in heartfelt, respectful, and good-faith debate on very sensitive issues. In the end, they based their decision on the evidence and what each legislator individually believed in his or her heart was right for the people of the state. Governor Polis recognized that, as distasteful as the crimes were that resulted in the three remaining death sentences in the state, it was better to close out this chapter in Colorado’s criminal justice history than to let the issue fester while unnecessarily spending millions more of taxpayer dollars.

On the first anniversary of the crash of United Airlines Flight 93, Homeland Security Director Tom Ridge delivered a speech at the site of the disaster in western Pennsylvania. “Faced with the most frightening circumstances one could possibly imagine,” he told grieving relatives of the passengers and crewmembers aboard the fourth plane hijacked on 9/11, “they met the challenge like citizen soldiers, like Americans.” He recited the now-familiar story of passengers learning by phone about the attacks on the World Trade Center and Pentagon, deciding to fight back and breaking into the cockpit–a heroic act that led to their own deaths while sparing countless others in Washington.
“The terrorists were right to fear an uprising,” Ridge rhapsodized. “The passengers and crew did whatever they humanly could–boil water, phone the authorities, and ultimately rush the cockpit to foil the attack.”
Ridge’s boss repeatedly used United 93 to close his standard stump speech. Calling the passenger revolt “the most vivid and sad symbol of them all,” George W. Bush said: “People are flying across the country on an airplane, at least they thought they were. They learned the plane was going to be used as a weapon. They got on their telephones. They were told the true story. Many of them told their loved ones goodbye. They said they loved them. They said a prayer; a prayer was said. One guy said, ‘Let’s roll.’ They took the plane into the ground.”
The legend of Flight 93 had everything a nation caught with its pants down needed to feel better about itself: guts, heroism, self-sacrifice. Best of all, it was marketable–by Hollywood and by a president willing to surf on a kind of heroism notably absent from his own life. (Theatrical release of the second “United 93” movie is scheduled to open April 28.) Lisa Beamer, widow of the passenger credited with the call-to-arms “let’s roll,” wrote a bestselling book by the same name, applied for a trademark on the expression, and is now working the Christianist lecture circuit.
Actually, the 9/11 Commission found, the evidence indicates that what Todd Beamer (or someone else) said was not “let’s roll,” but “roll it”–possibly referring to an airplane service cart the passengers may have wanted to use to break down the door into the cockpit. Too bad-. “Roll it” sounds less cinematic, and more like a book about cinematography.
The first indication that government officials were covering up the truth about United 93 came with their refusal to make public the cockpit voice recording (CVR). Releasing CVRs after a crash has long been standard practice; pilots’ last, usually profane, utterances have become a cliche. Yet the FBI stonewalled victims’ relatives for months after 9/11.
“While we empathize with the grieving families,” assistant director John Collingwood wrote one widow, “we do not believe that the horror captured on the cockpit voice recording will console them in any way.” And yet, if the tape contained inspiring proof of the passenger revolt and its success, it would have been one hell of a lot more consoling than Tom Ridge’s oratory. Why not release it?
Finally, after seven months of political pressure, the FBI allowed United 93 relatives to listen to the CVR. The feds told the families not to reveal what they’d heard. “They said the information on the tapes could be possibly used in the prosecution of [alleged “20th hijacker” Zacarias] Moussaoui, and anything that we say could affect the case in a negative way,” said the brother of one of the victims.
Though they studied the recording, the 9/11 Commission found zero evidence that the passenger revolt succeeded, that they made it into the cockpit and, as Bush claimed, “took the plane into the ground.” Tom Kean & Co. offered only conjecture: “The hijackers remained at the controls but must have judged that the passengers were only seconds from overcoming them.”
“Must have.” At a time when war can be justified by waving around a bottle of fake anthrax on TV, “must have” is judged adequate proof.
Another eyebrow-raising portion of the official account of Flight 93 states that “the passengers and flight crew began a series of calls from GTE airphones and cellular phones” after the hijacking. Ever forgotten to turn off your cellphone during a flight? I have. Try it yourself: Cellular telephone calls tend to drop when you’re driving at 60 miles per hour; passenger jets travel up to ten times that speed. Moreover, there’s zero signal, and thus no ability to place a call, above 8,000 feet. Flight 93, en route from Newark to San Francisco at a cruising altitude of 35,000 feet, dropped 700 feet when it was hijacked at 9:28 am. Cell calls? Not likely.
The Bush Administration has alternately claimed that the White House, then the Capitol, and finally the White House again was the target of the Flight 93 hijackers. Sure,
