I have opined that FBI Director Chris Wray needs to shut the @#$%! up about encryption. Wray has presented a completely skewed perspective on the issue, following in the footsteps of Jim Comey. Wray claims encryption is leading to a criminal apocalypse, even as crime rates remain at historic lows. He also claims encryption is making it impossible to follow through with investigations, but has presented no evidence to back this claim.
The best argument the FBI could present was its always-growing number of encrypted devices in its possession. In the space of a couple of years, the number jumped from less than 900 to nearly 8,000. This seemed to indicate encryption was a growing problem, but when the FBI tried to verify this number for Congress, it found out it had overstated the amount of locked devices in its possession. In reality, the number of locked devices is likely less than 2,000 -- hardly the apocalypse of impregnability Wray and Comey continuously presented. This was discovered i

If so, you are not wrong. Childhood bullies have a predisposition to become adult bullies, research shows, and, sure enough, it seems Attorney General William Barr was a teenage bully more than 50 years ago.
Back in 1991, during Barr’s confirmation to be George H.W. Bush’s attorney general, lawyer Jimmy Lohman, who overlapped with Barr at New York’s Horace Mann School and later Columbia University, wrote a piece for the little-known Florida Flambeau newspaper about Barr being “my very own high-school tormentor” — a “classic bully” and “power abuser” in the 1960s who “put the crunch on me every chance [he] got.”

    Over the last few years troubling allegations have been raised concerning the FBI. These allegations have been raised principally by Dr. Frederic Whitehurst, a supervisory special agent who works in the FBI lab. The numerous allegations that Dr. Whitehurst raised eventually resulted in an investigation by the Department of Justice's Inspector General. The results of that investigation were released just last month, and a 500-page report is the subject of today's hearing

    For example, in the case of United States versus Psinakis, the FBI explosives examiner reached the conclusion that tools found in the defendant's home contained residue of an explosive by relying in part on collateral evidence that was collected during a search of the defendant's garbage, rather than conducting appropriate scientific tests of the tools themselves. We specifically concluded that the examiner's work in the Psinakis case was inadequate and unprofessional.

    In the case involving the bombing of an Avianca Airlines jet, we determined that the FBI explosives examiner's testimony regarding the type of bomb used was based on a theory that was scientifically unsound and beyond the examiner's expertise.

    We found other instances of examiners giving inaccurate testimony. In a hearing conducted by the Investigating Committee of the Judicial Council of the Eleventh Circuit regarding then-judge Alcee Hastings, the lab examiner testified falsely that he had performed a certain scientific test, when in fact another examiner had performed the test, and he also testified inaccurately regarding the results and significance of the test.

    In a death penalty case in Florida, another examiner, who was the chief of the Chemistry-Toxicology Unit, testified inaccurately on several points, including testimony about tests he had performed or the results of those tests.

Roughly 500,000 Americans, who were not previous users, got HCQ scripts in March and April--at the time 1 M cases were diagnosed

The CDC has just released information, in its MMWR Weekly Report, on the prescribing of hydroxychloroquine in March and April in the US.

Approximately 500,000 prescriptions dispensed by retail pharmacies were "new," or dispensed to persons who had not received a previous prescription of the medication in the prior 12 months. These are presumed to have been in response to Covid-19.

By April 30, there were 1,075,000 confirmed or probable Covid cases in the US.

CDC's report has not examined how many of those receiving HCQ also tested positive for Covid. 

Nonetheless, it appears that a considerable number of Americans and their physicians saw value in using the drug to prevent or treat Covid, especially compared to the number of total known cases.  Where are their voices now?  Did the medication help?  Hurt?  

The rest of the country is dying to know.

Serious concerns with the conduct of the Covid-19 vaccine clinical trials

Did you know…this past week major media outlets reported four new serious concerns about the Covid-19 vaccine trials?

•NY Times 9/22: Two vaccine experts identify a major flaw in the Covid-19 vaccine trials. The trials are focusing on whether the vaccines prevent mild disease, not moderate or severe disease which are the major concerns. (1)

•Washington Post 9/22: A former Harvard Medical School physician and AIDS researcher, Dr. William Hazeltine, agrees with the NY Times article. Further he notes that the design of Pfizer and Moderna vaccine trials is such that they could be considered a success with fewer than 100 people vaccinated. These are not nearly enough numbers to determine long-term efficacy and safety. (2)

•CNN 9/25: The AstraZeneca Covid-19 trial is still paused in the US as more information is becoming available about 2 participants in UK who experienced severe neurological autoimmune diseases during the vaccine trial. US physicians question whether the diseases are unrelated to the vaccine as AstraZeneca claims. (3)

•NBC News 9/24: Perhaps most alarming is the news that Dr. Richard Whitley, the chair of the US Data Safety and Monitoring Board (DSMB) evaluating the vaccine trials in the US, has significant conflicts of interest. In 2019 he received consulting fees from GlaxoSmithKline (GSK) which is making a COVID-19 vaccine, and he is on the board of Gilead Sciences which manufactures remdesivir. He also oversees another DSMB for GSK. The identities of the other members of the DSMB are being withheld. According to conflict of interest guidelines, DSMB members or their family members should have no professional, proprietary or financial relationship with companies sponsoring the research.  (4)

•In a Pew Research Center poll of over 10,000 Americans conducted September 8-13, those who say they would get a COVID-19 vaccine has dropped sharply with only 21% stating they would “definitely” get the vaccine. (5)

The Emergency Use Authorization for Covid-19 vaccines: Ignorance is Bliss

If you are an FDA official charged with approving a Covid-19 vaccine, ignorance is bliss.  FDA is being asked to approve vaccines that will be injected into many millions of people, all using new methods of vaccination that have never before been approved for human use.  That puts them at great risk of making the wrong decision.

However, the lawyers who wrote the Emergency Use Authorization (EUA) legislation understood the FDA bureaucracy and its risk aversion. They probably also worked for, or consulted with, the pandemic vaccine industry.
And so they came up with a standard that practically mandates the most minimal collection of information from clinical trials of vaccines for which emergency use authorization will be sought.  Instead of requiring specific information, the standard simply says that in order to receive an EUA, a product's known and potential benefits should outweigh its known and potential risks. So, the more its sponsor knows about adverse effects, the more trouble the vaccine is likely to have getting approved.  Accordingly, it is better for the adverse effects to be as unknown as possible.
This standard also explains what might be considered oddities in trial design:  for example, why the vaccine sponsors/developers did not collect data on whether the vaccines prevented transmission of disease. Nor were vaccine sponsors required to show statistically significant data on whether hospitalizations (severe illness) and deaths were prevented.
Basically, the FDA was given the statutory green light to approve anything it wanted to approve, with minimal actual data.  That is how Operation Warp Speed could even be conceived.
Most important, from the standpoint of FDA, it gave the agency cover.  FDA is not being asked to act as a regulator. All it needs to be able to say is that the potential for benefit exceeds the potential risks, and as long as little is actually known about the vaccines, they can say their approval was based on the best evidence available at the time. This is of course another reason for speed:  the vaccines need to be approved before meaningful safety and efficacy data accrue that could hurt them.
FDA Commissioner Stephen Hahn and CBER director Peter Marks have tiptoed around and obfuscated this.
"Look at the process that we're following," Dr. Peter Marks said. "We're going to have a very open process."
But the FDA only said it would publicly disclose reviews of the scientific data used to authorize drugs and vaccines after being criticized for hiding information. The Government Accountability Office noted that the FDA had not been sufficiently transparent in disclosing the data used to grant or revoke authorizations involving coronavirus treatments.
Dr. Hahn told USA Today "The standard that’s used for an EUA is that it must be effective..." But that is not the actual standard, which is that a vaccine's known and potential benefits should outweigh its known and potential risks.  In other words, FDA is only required to guess at its safety and effectiveness. Hahn also told USAT that the standards for EUA approval "are very similar" to the standards for issuing a license, which is far from true. 
Here is what the FDA advised Covid vaccine developers on applying for an Emergency Use Authorization:
"Based on this declaration and determination, FDA may issue an EUA after FDA has determined that the following statutory requirements are met (section 564 of the FD&C Act (21 U.S.C. 360bbb-3)) (Ref. 3): 
* Based on the totality of scientific evidence available, including data from adequate and well- controlled trials, if available, it is reasonable to believe that the product may be effective to prevent, diagnose, or treat such serious or life-threatening disease or condition that can be caused by SARS-CoV-2.
* The known and potential benefits of the product, when used to diagnose, prevent, or treat the identified serious or life-threatening disease or condition, outweigh the known and potential risks of the product.
* There is no adequate, approved, and available alternative to the product for diagnosing, preventing, or treating the disease or condition."
The glue that holds this sham of a regulatory process together is the extraordinarily broad liability protection afforded to everyone with any responsibility for the medical products used under an EUA.  You don't learn about this in the EUA declarations. Instead, you must read the Prep Act and its amendments. The following "Public Readiness and Emergency Preparedness Act for Medical Countermeasures Against COVID–19," was published in the August 24, 2020 Federal Register. Everyone who has anything do with Covid vaccines has had all liability waived (with the sliver of an exception for willful misconduct).
And recently pharmacists and pharmacy interns had their liability waived for administering any recommended childhood vaccine to any child over age 3!  The justification is that since Covid-19 has reduced routine childhood vaccinations, any pharmacy employee can now administer any of those vaccinations, while facing no potential liability, via a Covid PREP Act declaration.

Book Description: Today, more than 200,000 men and women over age fifty are languishing in prisons around the United States. It is projected that by 2030, one-third of all incarcerated individuals will be older adults. An already overcrowded and underserved prison system is straining to manage the needs of incarcerated older adults with growing frailty and health concerns. Separated from their families and communities despite a low risk of recidivism, incarcerated older adults represent a major social-justice issue that reveals the intersectional factors at play in their imprisonment. How do the people aging in prison understand their life experiences?
In Aging Behind Prison Walls, Tina Maschi and Keith Morgen offer a data-driven and compassionate analysis of the lives of incarcerated older people. They explore the transferable resiliencies and coping strategies used by incarcerated aging adults to make meaning of their lives before, during, and after imprisonment. The book draws on extensive quantitative and qualitative research as well as national datasets. It features rich narrative case studies that present stories of trauma, coping, and well-being. Based on the data, Maschi and Morgen present a solution-focused caring-justice framework in order to understand and transform the individual- and community-level structural factors that have led to and perpetuate the aging-in-prison crisis. They offer concrete proposals—at the community and national policy levels—to address the pressing issues of incarcerated elders.

LA Unified School District Backs off its demand for vaccine mandates/passport

I was told this turnaround occurred the evening of May 13.  I have not seen it in the news yet.  The school district had been challenged with a lawsuit after announcing a vaccine mandate and passport arrangement for all teachers students and employees of the district. Apparently the LAUSD board and superintendents finally had a lawyer explain EUA law to them.

There have been decisions already made by colleges around the country that said, “If you’re on faculty or you’re a student, you’re not coming next year if you’re not vaccinated.” Now, they have the ability to do that. These are tough questions with even tougher answers, but if we’re going to get that last mile coverage, we’re going to have to start portraying that we’re willing to do to ourselves what we’re asking the American people to do
Notably, Senator Burr is a Pharma shill and was investigated over insider trading last year.  His aide is Dr. Robert Kadlec, whose role in transferring agency funds away from N95 masks, gown and PPE and into anthrax and smallpox vaccines while assistant secretary of health and human services for emergency response last year instead will come under fire at a House Select Committee hearing on the Pandemic Response this coming Tuesday am.

If you are vaccinated you can take off your mask. Why now?

 The reason why CDC is allowing the vaccinated to stop wearing masks indoors, I'd guess, is based on several things:
1.  To give people an incentive to be vaccinated--getting those vaccines into arms seems to be a huge priority for some reason, as cases and deaths are falling off a cliff and therefore the benefit to be gained from them also nosedives.
2.  As I have said for a year, the masks do not work (most of them) against aerosol spread.  So it makes sense, now that CDC has admitted aerosol spread exists, that indoor masks are coming off, since they did not protect people anyway.
3.  Masks are a compliance manuever, a way to demonstrate one goes along with (i.m.o. illogical) edicts.  Did CDC find fewer and fewer people were wearing them, and decided to get in front of the trend, before we noticed?
4.  There have to be ways to punish the unvaccinated, and this is one.
5.  Seems like CDC is not going to impose or finance improved ventilation systems in buildings, although everything else seems to be paid for with federal revenue.

Another bogus analysis of ivermectin with a shady background, coming from Peru and from US pharma consultants

While it is very hard to create a study showing that a  successful drug does not work, it can be done, with the right people and funding. This appears to have happened in a paper published June 28 by a group of latin american and US authors.
Ivermectin studies were cherrypicked to yield a poor outcome.  This is no easy task, since virtually all of the 60 studies in existence show positive benefits.
Here is the new study that was designed to sink ivermectin treatment of Covid. It was published by Oxford University Press, for the IDSA (the organization that has covered up chronic Lyme disease for over 30 years):

Among the authors are people who you would not expect to be studying ivermectin.
The authors include an employee of Cello Health, the Centro de Investigación, Instituto Peruano de Oncología y Radioterapia (IPOR), and the Unidad de revisiones sistemáticas y meta-análisis, guías de práctica clínica y evaluaciones de tecnologías sanitarias (URSIGET).  The last 2 are in Peru.
Cello Health is a high end consulting company, mostly to Pharma.  It claims to work with 24 of the top 25 pharma companies in the world.  Its website brags about "Competitor Planning and Response." One of its consulting jobs is "supporting the Scottish Government in the creation of a series of compelling public health campaigns to drive social distancing and self-isolation..."  
IPOR is a cancer treatment center in Lima, Peru.  Its long list of partners includes the NIH and many large pharmaceutical companies.  When you open the website you see a pop-up offering vaccinations. 
URSIGET, as best I can tell, is a Peruvian organization designed to help train scientists how to write papers and get research grants.
All 3 of these organizations have a focus on consulting and making money.  The authors are not academics.  Yet the paper claims:
Funding: No funding was received for this study. 
Acknowledgment: None. 
Conflict of Interest: The authors declare that there is no conflict of interest.
Do you believe it?  I don't. This looks like another form of paid hit job, grossly similar to the Colombian paper dissing ivermectin I wrote about 4 months ago. It was probably farmed out to a foreign country to make its financial trail harder to identify.
It has been criticized by Tess Lawrie and Pierre Kory's groups.  Here is a compilation of 60 ivermectin studies so you can compare the overall results with those of this paper.

We systematically assessed benefits and harms of the use of ivermectin (IVM) in COVID-19 patients.
Published and preprint randomized controlled trials (RCTs) assessing IVM effects on COVID-19 adult patients were searched until March 22, 2021 in five engines. Primary outcomes were all-cause mortality, length of stay (LOS), and adverse events (AE). Secondary outcomes included viral clearance and severe AEs. Risk of bias (RoB) was evaluated using Cochrane RoB 2·0 tool. Inverse variance random effect meta-analyses were performed. with quality of evidence (QoE) evaluated using GRADE methodology.
Ten RCTs (n=1173) were included. Controls were standard of care [SOC] in five RCTs and placebo in five RCTs. COVID-19 disease severity was mild in 8 RCTs, moderate in one RCT, and mild and moderate in one RCT. IVM did not reduce all-cause mortality vs. controls (RR 0.37, 95%CI 0.12 to 1.13, very low QoE) or LOS vs. controls (MD 0.72 days, 95%CI −0.86 to 2.29, very low QoE). AEs, severe AE and viral clearance were similar between IVM and controls (all outcomes: low QoE). Subgroups by severity of COVID-19 or RoB were mostly consistent with main analyses; all-cause mortality in three RCTs at high RoB was reduced with IVM.
In comparison to SOC or placebo, IVM did not reduce all-cause mortality, length of stay or viral clearance in RCTs in COVID-19 patients with mostly mild disease. IVM did not have an effect on AEs or severe AEs. IVM is not a viable option to treat COVID-19 patients.

The July 6 NYT updated us on shareholder lawsuits against EBS, including the lucrative stock trades of Board chair and founder el Hibri ($42 million recently), President Kramer ($10 million) and even board member Louis Sullivan MD, the first black person to be Secretary of the DHHS ($3 million). 
The Biden administration just exercised a contract to buy another $182 Million dollars' worth of smallpox vaccine for the civilian stockpile.  But I must remind readers, the USG had an old stockpile it destroyed shortly before 2001.  Then the Bush2 administration bought a shot for every American.  Old vaccine has been shown to retain activity for many years.  One wonders how much "lobbying " this contract cost EBS.  Because it seems this purchase will be enough to shut up Democratic Government Reform House members from their vendetta against the company, which was focused on crony contracts during the Trump administration.
But there is even more cringe-worthy material.  Vaccine is being shipped, even though it is adulterated.  That is what can be done under an EUA:  waive the requirement for manufacturing approval.  Read it and weep:  "No corners were cut."
The agency has since allowed about 40 million Johnson & Johnson doses manufactured at the factory to be distributed for use — but with a warning that regulators couldn’t guarantee that Emergent had followed good manufacturing practices. Even with the latest batch cleared for release on Friday, Johnson & Johnson remains nearly 40 million doses short of the 100 million doses called for in its federal contract.

Some of the voluminous evidence that prior infection confers good immunity while (Israel's Pfizer) vaccination does not

Readers are demanding citations proving natural immunity is far better than vaccine-induced immunity for Covid.  As my readers know I scan large amouns of material and cannot recall all the epi stats on this subject, but below are 4 references I just found, 2 on waning vaccine immunity, one on the rarity of repeat covid infections in healthcare workers, one on repeat infections in Indians.
The other type of evidence is the persistence of T cell immunity after vaccination.  A convincing report on this came out in the past 2 weeks by the La Jolla team of immunologists that includes Shane Crotty.

About half of adults infected in an outbreak of the Delta variant of Covid-19 in Israel were fully inoculated with the Pfizer vaccine, according to a clarification by Prof. Balicer of an earlier statement. An earlier version of this article incorrectly said about half of people infected in the outbreak were fully inoculated.
"As seen in real world data released from the Israel Ministry of Health, vaccine efficacy in preventing both infection and symptomatic disease has declined six months post-vaccination, although efficacy in preventing serious illnesses remains high," the statement said, according to multiple news outlets.
Israeli officials are reporting a 30% decrease in the effectiveness of the Pfizer COVID-19 vaccine to prevent infection and mild to moderate cases. At the same time, however, protection against hospitalization and severe illness remains robust.
The country's Ministry of Health data shows high levels of circulating Delta variant and a relaxation of public health measures in early June led to a drop in the vaccine's prevention of "breakthrough" cases from 94% to 64% in recent weeks.
The data suggest that repeat infections are rare — they occurred in fewer than 1% of about 6,600 participants who had already been ill with COVID-19.

New Delhi: Reinfection among people who have recovered from COVID-19 is rare and natural immunity after illness lasts around nine months, a study involving long term follows up of more than 1,000 people in Pune has found.

According to the Times of India, a study conducted by epidemiologists and community medicine experts from the DY Patil Medical College and Hospital in the city tracked 1,081 people who showed SARS-CoV-2 antibodies during a serosurvey in September last year until this past June. During the nine months of observation, just 13 participants – just 1.2% – were reinfected. The study, which is still in pre-print, also found that all those who were reinfected only had mild cases of COVID-19 and made a full recovery.

2017 article in a Nature journal discusses ivermectin effects (even against cancer) and mechanisms of action.

Someone wrote this in 2017.  Some people thus knew ivermectin had antiviral properties.  In fact, the drug has all kinds of possibly miraculous effects.  It is just missing the important one:  patentability.  (It was patented but the patent expired.) 
Recent research has confounded the belief, held for most of the past 40 years, that ivermectin was devoid of any antiviral characteristics. Ivermectin has been found to potently inhibit replication of the yellow fever virus, with EC50 values in the sub-nanomolar range. It also inhibits replication in several other flaviviruses, including dengue, Japanese encephalitis and tick-borne encephalitis, probably by targeting non-structural 3 helicase activity.97 Ivermectin inhibits dengue viruses and interrupts virus replication, bestowing protection against infection with all distinct virus serotypes, and has unexplored potential as a dengue antiviral.98 Ivermectin has also been demonstrated to be a potent broadspectrum specific inhibitor of importin α/β-mediated nuclear transport and demonstrates antiviral activity against several RNA viruses by blocking the nuclear trafficking of viral proteins. It has been shown to have potent antiviral action against HIV-1 and dengue viruses, both of which are dependent on the importin protein superfamily for several key cellular processes. Ivermectin may be of import in disrupting HIV-1 integrase in HIV-1 as well as NS-5 (non-structural protein 5) polymerase in dengue viruses.99,100...
There is a continuously accumulating body of evidence that ivermectin may have substantial value in the treatment of a variety of cancers. The avermectins are known to possess pronounced antitumor activity,107 as well as the ability to potentiate the antitumor action of vincristine on Ehrlich carcinoma, melanoma B16 and P388 lymphoid leukemia, including the vincristine-resistant strain P388.108 Over the past few years, there have been steadily increasing reports that ivermectin may have varying uses as an anti-cancer agent, as it has been shown to exhibit both anti-cancer and anti-cancer stem cell properties. An in silico chemical genomics approach designed to predict whether any existing drugs might be useful in tackling glioblastoma, lung and breast cancer, indicated that ivermectin may be a useful compound in this respect.109 In human ovarian cancer and NF2 tumor cell lines, high-dose ivermectin inactivates protein kinase PAK1 and blocks PAK1- dependent growth. PAK proteins are essential for cytoskeletal reorganization and nuclear signaling, PAK1 being implicated in tumor genesis while inhibiting PAK1 signals induces tumor cell apoptosis (cell death). PAK1 is essential for the growth of more than 70% of all human cancers, including breast, prostate, pancreatic, colon, gastric, lung, cervical and thyroid cancers, as well as hepatoma, glioma, melanoma, multiple myeloma and for neurofibromatosis tumors.110 Globally, breast cancer is the most common cancer among women but treatment options are few. Ivermectin suppresses breast cancer by activating cytostatic autophagy, disrupting cellular signaling in the process, probably by reducing PAK1 expression...

Spain’s top court rules pandemic lockdown ‘unconstitutional’/ The Independent

Last year’s stay-at-home lockdown order by the government under a state of emergency was unconstitutional, Spain’s constitutional court has ruled on Wednesday.
The court ruling was in response to a suit filed by the far-right Vox party.
It was a split decision according to a brief statement issued by the court. State broadcaster TVE said six magistrates voted in favour and five against.

According to the Spanish broadcaster, the ruling said that the limitations on movement violated citizens’ basic rights and therefore the state of emergency was insufficient to give them constitutional backing.

Frederic Whitehurst had what it takes to change the FBI forever. A highly decorated three tour veteran of the Vietnam War, the youngest recipient of the Navy Medal for Heroism, a Ph.D. From Duke University in Chemistry, along with a Post Doc. Degree from Texas A&M. He advanced quickly up the ranks of the FBI and soon became a Supervisory Special Agent and the FBI’s top explosive expert. By the time his whistleblowing was done, he had forced the FBI to accredit its laboratory and obtained outside oversight of the FBI for the first time in history. His whistleblower case forced President Clinton to issue a directive granting whistleblower rights to every FBI agent. Whitehurst obtained a record-breaking $1.4 million settlement with the government.

Supervisory Special Agent Frederic Whitehurst was the FBI’s leading expert on explosives. In 1993, terrorists tried to take down the World Trade Center and set off a bomb in the building’s garage. Whitehurst was sent to the crime scene in New York and was responsible for securing the crime scene. His work trying to solve the crime soon took a turn for the worst when he realized that FBI officials were manipulating the forensic evidence and trying to use fraudulent science to convict the suspects. Whitehurst took unprecedented steps in trying to prevent fraud at the trial, which could have threatened the entire prosecution.
Whitehurst hired the attorneys at Kohn, Kohn and Colapinto to help him blow the whistle. However, because he had the highest possible security clearances, and because he was involved in the most sensitive terrorist case of the decade, the Attorney General tried to block him from even talking to his counsel and threatened him with prosecution if he revealed anything outside of the narrow confines of the FBI or DOJ.
Boxed in, Whitehurst made a bold move. He wrote two memos outlining the forensic misconduct that was undermining the integrity of the prosecution of the World Trade Center suspected terrorists. He gave these memos to agents from the Justice Department. They were eventually sent up the chain of command and landed on the desk of the Judge hearing the World Trade Center bombing case. The Judge immediately recognized that these memos contained what is known as Brady information, i.e., information that could impact whether or not a defendant could be found guilty. The Judge ordered the FBI to make Whitehurst available to questioning by the attorneys for the defendants.
There was one catch. Whitehurst would not testify unless his right to be represented by counsel was protected. The FBI was forced to rescind the restrictions on Whitehurst’s ability to communicate with his attorneys. History changed. Once his counsel lawfully learned the full scope of the forensic misconduct ongoing at the FBI, they were able to file lawsuits on his behalf and present his case internally to the government oversight offices. The result was ugly. The Documentary proof was offered that the FBI lied in a proceeding designed to impeach an African-American Judge, thousands of cases were called into question because of frauds committed by examiners, and misconduct was documented in other high-profile cases, including the Oklahoma City Bombing case and the O.J Simpson murder trial.
The pressure on the FBI to reform was intense. The Bureau was compelled to permit Whitehurst to speak on-air to the major ABC-TV investigative program, Prime Time Live, where he recounted many of his concerns. As a result, the Attorney General appointed a special blue ribbon panel to review the Crime Lab. The results fully vindicated Whitehurst. The DOJ Inspector General concluded that 13 FBI Lab examiners had engaged in misconduct, and some were removed from the laboratory. Old cases were ordered to be reexamined, and over fifty reforms were suggested, including the accreditation of the crime lab. The FBI agreed to implement every reform.
Whitehurst was not done. His court case forced President William Clinton to issue an order directing the Attorney General to establish whistleblower protections for all FBI employees. See Memorandum of President William Jefferson Clinton, Vol. 62 Federal Register No. 81, p. 23123 (April 14, 1997). Additionally, the investigation into the laboratory by the DOJ Inspector General was unprecedented and resulted in an agreement that the DOJ IG would have permanent oversight responsibility over the FBI. This reform has had the greatest long-term impact on improving the integrity of the FBI.
In 1998, the FBI and DOJ agreed to settle Dr. Whitehurst’s whistleblower retaliation claims, cleared his record, restored all of his rights, and paid him a record-breaking settlement of $1.42 million an amount unheard of for any federal employee, least of all an FBI agent.

Here is information about the first 3 matters taken up by the Board of Medical Licensure in my case. Guess I am guilty of giving the correct, safest drug to a pregnant woman

The Maine Board of Medical Licensure has 5 matters before it in my case. Here are the first 3:
The first 2 are complaints from private citizens, who claimed that I spread misinformation on the internet.  Neither complainant knows me or is a patient.  Neither complaint has anything to do with medical care.  Each says the complaint was initiated after they watched me in a video. One said the information I was disseminatiog was a "danger to the public." 
The third complaint is from a midwife who complained that I gave a pregnant patient hydroxychloroquine for acute COVID without asking her, when she could have given the patient monoclonal antibodies instead.
My response is that hydroxychloroquine is approved in pregnancy and is a safe, licensed drug.  Monoclonal antibodies are an experimental biologic product that have not been approved in pregnancy; in fact, the pregnancy risks have not even been studied. The midwife apparently did not know this about the product she is prescribing in pregnancy.
Unapproved drugs have no label.  For a legal description of what is known about them, one must read a fact sheet.  For example, here is what the FDA-approved Fact Sheet for sotrovimab, the only commonly used monoclonal said to be effective against omicron, says about its risk in pregnancy:

"11.1 Pregnancy Risk Summary 
There are insufficient data to evaluate a drug-associated risk of major birth defects, miscarriage, or adverse maternal or fetal outcome. Sotrovimab should be used during pregnancy only if the potential benefit justifies the potential risk for the mother and the fetus. Nonclinical reproductive toxicity studies have not been conducted with sotrovimab. In a crossreactive binding assay using a protein array enriched for human embryofetal proteins, no offtarget binding was detected for sotrovimab. Since sotrovimab is a recombinant human immunoglobulin G (IgG) containing the LS modification in the Fc domain, it has the potential for placental transfer from the mother to the developing fetus. The potential treatment benefit or risk of placental transfer of sotrovimab to the developing fetus is not known. The estimated background risk of major birth defects and miscarriage for the indicated population is unknown."
On the other hand, the label for hydroxychloroquine says the following about use in pregnancy:
Teratogenic Effects: Human pregnancies resulting in live births have been reported in the literature and no increase in the rate of birth defects has been demonstrated. Embryonic deaths and malformations of anophthalmia and microphthalmia in the offspring have been reported when pregnant rats received large doses of chloroquine." 
What does CDC say about hydroxychloroquine in pregnancy?

"Hydroxychloroquine can be prescribed to adults and children of all ages. It can also be safely taken by pregnant women and nursing mothers."
Do you think perhaps the Medical Board and the complaining midwife bothered to check this information?  I think not.

The "crime" of misinformation is only a crime if the information is false and is known to be false by the person making the statement.

I would suggest that those attorneys who work for the Maine Medical Board look up the law regarding misinformation.  They also should be informed that they do not make the law:  law is made by legislatures and Congress.  They have not been given the authority to create new crimes.  My opinions, which are grounded in an enormous amount of fact and study, and are accurate almost all the time, do not meet the statutory standard of false information.
I would further suggest that the Board attorneys inform the Board members of this.  I think they might want to know that they have been handed a nonexistent crime to prosecute.

The Necessary Embrace of Conspiracy

Several years ago I gave a talk on Martha's Vineyard about many of the people whose portraits I've painted in the Americans Who Tell the Truth series. I spent some time talking about the legacy of Martin Luther King, Jr. When I talk about King, I like to focus on his last year --- the period when, defying the advice of many of his advisors in the civil rights movement, he spoke against the Vietnam War, equating racism with imperialism. King felt bound to make the point that the forces of capitalism, materialism, and militarism that were driving segregation were also driving the war, and until we confronted the source of the problem, the abuses would continue. It was April 4, 1967, in Riverside Church in New York, that he made that declaration. A year to the day before his assassination.
It has always confounded me every year when we celebrate Dr. King's life that no mention is made of that Riverside Church speech in the major media. We are always treated to sound bites of the 1963 I Have a Dream speech. That speech's oratory is as powerful as it is non-confrontational. Which is why it is re-played for modern audiences. Dr. King was about confrontation. Non-violence and confrontation, each ennobling and making the other effective. In 1967 he said, "... my country is the greatest purveyor of violence in the world today." And he explained how our economic system thrived on exploitation and violence, or, as Emma Goldman put it, "The greatest bulwark of capitalism is militarism." This was probably the most important speech King ever gave and not playing it when we ostensibly honor him, is tantamount to castrating him morally and intellectually. Just as there is a long history of White America castrating black men, there is an equal legacy of Elite America cutting the most important truths of our social prophets out of the history books. We pay homage to King's icon, the cardboard cutout, but not to his strongest beliefs and his most cogent analysis of our problems --- to what vision called forth his courage. And, if we think that he spoke the truth, to censor that truth is to promote a curious kind of segregation. He is segregated, not for the color of his skin, but for the accuracy of his perception, how close to the bone his words cut. We can't bear to hear the sound of truth's knife scraping on hypocrisy's bone. Only people who actually want to change the system dance to that music or want it to be heard.
Equally important, and part of the same neglect, is the intentional ignoring of the facts of his death. In my talk on Martha's Vineyard I spoke about William Pepper's book, An Act of State: The Execution of Martin Luther King, Jr. Pepper had been James Earl Ray's lawyer. Ray was the man convicted of killing King. But both Pepper and the King family were convinced that Ray was innocent. The King family hired Pepper to represent them in a suit; they asked only $100.00 in damages to clear Ray's name. Before the trial came to court in 1999, Ray had died in prison. The jury determined that King had been assassinated by a conspiracy involving the Memphis police, the Mafia, the FBI, and the Special Forces of the U.S. Army. Ray, the patsy, had left town before the shot was fired. Pepper had confessions from people involved from each of the organizations named. The verdict was barely mentioned in the U.S. media then and is not mentioned every year on the anniversary of his death. Why?
After my talk on Martha's Vineyard a man came up to me and said, "I enjoyed your speech and was with you until you started that conspiracy stuff about MLK, Jr." I said, "That's not conspiracy. What I told you are facts." End of conversation.
I think we're confronted with two conspiracies here: one to commit the crime, the other to ignore it even when the facts are known. ( Two sides of the same coin.) The man who accused me of slipping into the neurotic, aliens-are-among-us land of conspiracy nuts was unable to hear the evidence, perhaps because he was so utterly convinced by our government and media that conspiracies don't exist, people who espouse them are dangerous fruitcakes, and if you begin to think like that, your whole house of cards wobbles then topples. Who wants that? Better a standing tower of marked cards, than having to admit the game is rigged and the ground is shaking.
America is steeped in conspiracy, and even more steeped in propaganda that discredits those who try to expose the conspiracies. Whether we're talking about MLK, Jr., JFK, RFK, Iran-Contra, 9/11, or, most importantly, the status quo, anyone who works to uncover the truth is branded a "conspiracy nut" and discredited before any evidence has a fair hearing. The government/corporate/media version is THE VERSION. Anything else is illusory.
In fact, the cultural success of labeling investigative reporters and forensic historians, and, simply, anyone who tries to name reality, "conspiracy nuts" is perhaps the most successful conspiracy of our time. Well, not the most successful. That prize goes to the conspiracy to give corporations all the rights of individual persons under our Constitution. That conspiracy has codified and consolidated corporate power so that it controls our lives in almost every meaningful way. It controls the election funds of our candidates, and them once they are in office. It controls our major media including public broadcasting. It controls the content of our television programming. It controls how are tax dollars are spent making sure that the richest get the most welfare. It controls the laws, the courts, the prison system and the mind numbing propaganda that we are the greatest democracy on earth. It controls the values with which we raise our children. It controls our ability to dispense justice. It controls how we treat nature, how we deface our land with strip malls, and blow the tops off our mountains --- a form of corporate free speech. It dictates our modes of transportation. It controls our inability to respond to true crises like climate change. It attempts to create a spiritual deficiency in every person that can be filled and healed only with stuff --- and no stuff is ever enough.
As Richard Grossman puts it, "Isn't it an old story? People create what looks to be a nifty machine, a robot, called the corporation. Over time, the robots get together and overpower the people. ... For a century, the robots propagandize and indoctrinate each generation of people so they grow up believing that robots are people too, gifts from God and Mother Nature; that they are inevitable and the source of all that is good. How odd that we have been so gullible, so docile, obedient."
It is obvious to say that we have been engineered into a culture that values competitive consumption and consumers instead of community cooperation and citizenship. Capitalism with its obsessive and necessary appetite for consumption, expanding markets, resource depletion, and increasing profits has consumed democracy. Have you ever watched a small snake swallow a large frog? The snake's hinged jaw stretches wider and wider, squeezing the frog millimeter by millimeter into its gullet until finally the snake looks like the Holland Tunnel might if it had devoured the Titanic. Then the acids and enzymes do their corrosive work. The frog becomes the snake. And the snake claims it is the frog. Capitalism has gulped down democracy and claimed it is democracy. When, immediately after 9/11, President Bush advised Americans to demonstrate their love of freedom and their resistance to terrorism by courageously, selflessly, hurrying to the mall to buy something, he was speaking as the snake that identifies itself as a frog. He was asking us to play a little game with our brains' synapses, replace the snake icon with the frog's. Sadly, he may also have been speaking about democracy in the only way that he can understand or recognize it. And, for him, Christianity has been another tidy meal for the snake.
Perhaps this switcheroo is nowhere more obvious than in the military /industrial complex. We are told that the vulnerable frog needs protecting. The threats are grave. So we fork over our money and children's lives for war and weapons. We are told that we are building security and peace. More lives. More weapons. What we aren't told is that the largest US export to the world is weapons. What we aren't told is that enormous fortunes are being made from the arms trade. What we aren't told is that the more precarious and unstable the world is, the better the business for the arms dealers --- that the real promotion is not for security and peace but insecurity and war, that the lives of our children are the necessary collateral damage for this monster. What we aren't told is that the only real security is in cooperation, conservation, and fairness, not imperialism. The frog, who is a snake, wrapped in a flag, pleads for patriotism and counts the cash. The snake's forked tongue is a barbeque fork on which we've all been roasted.
I'd call that conspiracy.
The neocons have claimed, with some accuracy, that they can create reality faster than we can react: the deed is done, now deal with it. The troops have invaded, Halliburton, Blackwater, and Lockheed signed their contracts, the prisoners are tortured, your email is bugged, the resources for social programs are gone, the laws are changed, the Wal-Mart is built, the sludge dump has already polluted the aquifer, truth is hollowed out ---- catch me if you can! How is that not conspiracy?
The cooks & the crooks create a new status quo, legalize it, propagandize it, mythologize it, fundamentalize it, slather it with fear and patriotism, and force feed it to the complacent, sedated cow we call America. How is that not conspiracy?
Of course, ever since the Constitution was signed and didn't free the slaves or give the vote to women, poor folks, Native Americans and freed blacks so that people with power and money could continue to profit, America has been a conspiracy against itself. It's been cowboy grilling his own heart over a smoke & mirrors campfire, a CEO with inherited wealth and three hundred years of patrician, affirmative action crooning "Only in America."
The reason we can't talk about conspiracy is because it is the modus operandi. It isn't the elephant in the room, it is the room itself. We all live there. We can impeach a few elephants, and we should, but the architecture is in place. And they control it.
When I was in school, I was reminded - repeatedly --- to avoid using an indefinite pronoun without identifying whom it refers to, as in, "They are coming to get us," ... or, "They control everything." Who are They? It's bad practice to think and write like that. Without reference it just sounds like paranoia. But the hell of it is that it's damned hard to say who the They are that are in conspiracy to destroy democracy and, by exploitation, nature. Did They do it on purpose or merely discover by serendipity, like cavemen seeing copper ooze out of a rock by a fire, the wondrous possibility and power of what they had found. For instance, the invention of the TV was not a conspiracy. But once the realization of how TV could be used to submerge the public in a lobotomizing swamp of advertising, sound bites, inactivity, community destruction, titillation, false history, empty myth, consumption, and complicity in making fortunes for the sponsors, the program was clear. Conspiracy was the silent partner in the euphemism good business practice. And, once they saw the implications of giving corporations First Amendment rights, they were home free.
Time to re-think conspiracy.
We need to embrace conspiracy in two ways. One, admit that it's real, its quotidian, it's the fabric of our lives, the mercury in the air, the dioxin in the water, it's filling the airwaves and the marketplace and the courts and the halls of Congress before we even get out of bed every morning. Two, counter it with a conspiracy of our own. On our side we have the fundamental fact that although the corporate They can alter many of our realities, they can't alter Reality. They can't change the behavior of Nature. They can sell off the rain forest, but they can't leverage the effect of cutting it. They can keep the mileage of cars poor so we'll buy more gas, but they can't alter the amount of oil in the ground or the damage to the atmosphere. They can privatize every human interaction and every natural resource, but they can't privatize the laws of nature. They have conspired to change reality. We must conspire to live in harmony with Reality.
In the same way, they can conspire to kill Martin Luther King, Jr., but they can't totally eradicate the truth of who did it and why.
Con + spirare, from the Latin. To breathe together. Those are the roots of conspiracy. Breathing together doesn't sound like an activity of the ideologically deracinated whispering seditiously in a dank cellar or a board room, foul breaths denting a weak flame flickering over a candle nub, gunpowder or greed blackened fingers setting a timer, the whites of creased eyes glinting like knives with treason, murder, power, and deceit. Con + spirare sounds like healthy men and women standing in the sun figuring out how in the hell they are going to take care of each other and their aging mother Earth and love life while doing it. Breathing together, sharing the same air, plotting to make sure that what's mine is yours, conspiring to save their self-respect, their ideals, the future for their children.
I want to be part of a conspiracy. Pervasive, populist, revolutionary, and totally transparent. Grassroots. Idealistic. Simplistic. Life-affirming. Community building
A conspiracy to make the common good and the love of nature the common denominator of every economic transaction.
And the simple truth is either we start breathing together, conspiring big time, right out in the open, nakedly, unashamedly, or we will have conspired in secret, by default, in our own demise.
We have let them breathe for us, and they have stolen our breath, our air, our spirit.
Secret con + spirare is death. Open con + spirare is life.
Conspiracy is dead. Long live conspiracy!
