The form for Minor Party candidates has information on it which HURTS the Independent American Party and is 100% FALSE.

A minor party candidate can change party affiliation on the very last day that the Independent American Party can send in its finial list of candidates which is, according to NRS 293.1725 not later than 5 p.m. on the second Friday after the first Monday in May. The limitation on December 30th of the year before elections is ONLY on major party candidates and not minor party candidates.

The statute which uses the December 31st date is ABOUT MAJOR parties and not minor parties. No such statute limiting minor party candidates exists.

NRS 293.176 When candidacy for major political party prohibited; exception.

1. Except as otherwise provided in subsection 2, no person may be a candidate of a major political party for partisan office in any election if he has changed:

(a) The designation of his political party affiliation; or

(b) His designation of political party from nonpartisan to a designation of a political party affiliation,

Ê on an application to register to vote in the State of Nevada or in any other state during the time beginning on December 31 preceding the closing filing date for that election and ending on the date of that election whether or not his previous registration was still effective at the time of the change in party designation.

Now, frankly, I do not know if this has been incompetence on your part or if it is just more evidence of the never ending harassment of the Independent American Party by the State of Nevada but we want it corrected immediately. Our Clark County Chairman was upset all day when this information was sent to him by a person interested in being a candidate for the Independent American Party. Once again your harassment or incompetence has cost us valuable time and may have cost us a candidate for the 2008 AD election cycle.

In 2006 the Office of the Secretary of State sent out FALSE information on letters to past candidates that they owed civil penalties right when we were recruiting candidates and the party LOST candidates because of this. We are guessing that you are waiting until April or May to sue Janine Hansen, Whitney Hansen and Nicholas Hansen just before the deadlines on running for office since you have not sued us yet even though you promised you would.

Now that the Democrats have taken over at the Office of the Secretary of State it appears that the Harassment has not diminished but has indeed increased with the assistance of the Democrat in the Attorney General’s office.

You will note that the Declaration of Candidacy has September 1st on it instead of December 31st. You will also note that the statute on the Web site states: “I have not, in violation of the provisions of NRS 293.176, changed the designation of my political party or political party affiliation on an official application to register to vote in any state since September 1 before the closing filing date.

Did you READ NRS 293.176. It applies ONLY to major parties. Are you saying minor parties are major parties?

FIX THIS immediately. It is harming the IAP. If you do not fix this ASAP we will be forced, once again, due to the incompetence of the Office of the Secretary of State or the outright harassment of the IAP by the State of Nevada, to go to Court AGAIN! Will it ever end?

NRS 293.177 reads:

Declaration of Candidacy of …….. for the

Office of …………….

State of Nevada

County of …………………………..

For the purpose of having my name placed on the official ballot as a candidate for the ……………. Party nomination for the office of ………, I, the undersigned …….., do swear or affirm under penalty of perjury that I actually, as opposed to constructively, reside at ………., in the City or Town of ……., County of ………., State of Nevada; that my actual, as opposed to constructive, residence in the State, district, county, township, city or other area prescribed by law to which the office pertains began on a date at least 30 days immediately preceding the date of the close of filing of declarations of candidacy for this office; that my telephone number is …………, and the address at which I receive mail, if different than my residence, is ………; that I am registered as a member of the ……………. Party; that I am a qualified elector pursuant to Section 1 of Article 2 of the Constitution of the State of Nevada; that if I have ever been convicted of treason or a felony, my civil rights have been restored by a court of competent jurisdiction; that I have not, in violation of the provisions of NRS 293.176, changed the designation of my political party or political party affiliation on an official application to register to vote in any state since September 1 before the closing filing date for this election; that I generally believe in and intend to support the concepts found in the principles and policies of that political party in the coming election; that if nominated as a candidate of the …………….
